Hi all, I would appreciate if you gave me an insight/experience/opinion on the following, as I cannot find anything related on cic or here so far...

In a couple of months, I will probably apply for my wife's PR application, through CEC, and of course I will be the dependant member in that case.

While this will be being processed, we both have valid permits (SP for me/OWP for her) until July 2015...
I graduate on April 2015, and I plan on applying for a PGWP.

My question now:
-Will I have to apply also for my wife, for a new OWP based on my PGWP, as the CEC will not be finalized till then?
Her OWP will expire July 2015, and she has a job, so what then?
-Maybe it creates some sort of conflict having these 2 applications for the same person, "running" at the same time??

I am looking forward to some input here, especially from experienced members.
Thanks in advance, good luck to all out there trying for the best!!

Yes you can apply for an open work permit for your wife based on your PGWP regardless of a CEC application being processed at the same time.

I am in the same boat as you - was a full time student and my wife had an open work permit and after I graduated and got my PGWP my wife got a three year work permit based on my PGWP.

After the three years were up, we switched, my wife became a full time student and I got an open work permit based on her study permit. She should be graduating this coming December and I plan to apply for an open work permit based on her PGWP.

Just ensure the job you get is classified as a NOC 0, A or B so she can be eligible for an open work permit, otherwise she will only get a visitor record to remain in Canada but will be ineligible to work.

Now regarding the timing issue, try to apply for the PGWP ASAP right after your graduation or an announcement of graduation or with a transcript showing completion of your program and if possible, to try and arrange a job as described above. You will need a copy of a contract and at least one pay stub to send with your application so you can apply for an open permit for your wife.

Alternatively, if you are unable to find a NOC 0, A or B job, have your wife apply for a bridging work permit if you have received an AOR by the time. Always remember that you can take advantage of an implied status for her, so if she sends in her work permit say by July 14, she will be on implied status and can continue to work without violating the law.

Hope this helps.

Good luck.

Thank you for your detailed post.

Just to clarify something: An application for PGWP is complete as long as it shows your transcripts and that you have graduated, regardless of graduation day/convocation etc, right?

The job offer/pay stubs are for the spousal OWP later on, correct? Provided of course I have a skilled job.

For the sake of conversation, how come you haven't applied yet for PR, after these years?

Yes, a PGWP application is complete as long as you either have a convocation letter OR a transcript showing completion of your degree (that's what I used) OR copy of your diploma.

The job offer and pay stubs are for your spouse's OWP and not for yourself. You are eligible to apply for a PGWP regardless.

I haven't applied because we had to leave Canada for about 2 years during my PGWP and returned a few weeks before it expired. We sent our CEC application last week.

Cheers
