The papers that we sent were received (as the courier told us) at aroun 45 days ago. We still haven't received any emails though. Anyway, my question is , since the cap of our noc is increasing dangerously and it is at 325 already, is there any chance that we will not be in it in time?

what about your fees payment? did you track your payment method? Fnd out that your fees is cut from your payment method or not.
Once CIO charged your application fees you will get PER within 2 to 3months maximum (by email (always check your spam folder too) or by post).

I will try and check about our fees payment. nice idea. So as soon as the money is retracted or cashed it means we are safe in the cap? i hope we don't have to wait 2-3 months to enter the cap. also, shouldn't the money be taken out already? more than 45 days ago the papers were received

By post means your country postal service.
Paper were recieved is important but that does not mean you are elligible, after initial review of your application CIO will charge your fees and send you elligibility review by email or by postal service. ( PER is Positive eligibility review)
You will receive an email (mostly if you mentioned your email in application) from CIO if your file passes the Initial eligibility review , this email will also have details about your file and the file number.
Yes, once CIO charged fees that means you count for CAP and mostly people get PER soon. my mean is not 2 -3 months it's not like entered to CA. maximum 2 -3 months CIO take to issue you your filenumber & send email or letter (PER) and transfer your file to your visa office during this period.

I contacted the bank and they told me that the cheque is not cashed yet.

It has been 45 days though... should we be worried? How is this possible?

dontworry with many applicant it's take 72 days to 90days max to cleared application fees and than CIO sent PER soon.
still your cap is available and if your application and document is perfect than you will sure heard from CIO soon.
keep tracking the fees payment method after 10 to 15days.

One of my friend send his initial applicant and fee by mistake directly to LONDON VISA OFFICE not CIO, what will happen now?. he send his application on 27 oct 2011. still didnt hear any thing.

There is absolutely no cause for worry.

As per the timelines of MI3 applicants (post July 2011) the nmbr of days taken to encash your fees has been about 80 days from the date your application rchd CIO.

And the first every communication from CIO will reach you (by mail) in around 90 days.

What I would suggest is that when you complete about 65 days, send them a mail. They usually respond within 20 days, so by the time they respond your fee would have been cashed.

I predict my CAP will be reached within 30 days, which is faster than (as you all say) needed for the cheque to be cashed!!!! :o

Thats a bit hard to tell just yet. But by the way your NOC is going now, you should be in! As oer the latest update I saw, they are already working on 27th Sep (last week basically).

Hello staralihaider,

You are a VIP member and I have seen you helping a lot of members out here. Kudos to you for the great job you and some other seniors are doing. So when I saw your query, I couldnt help responding.

I am sorry to be the one telling you this. But this year they had STRICTLY instructed all applications along with ENTIRE documentation to be sent to CIO Sydney. Even PCC. Infact the first eligibility is being given by CIO this year (which we call the PER), and not the VO. So my humble suggestion would be for him to sent another set of documents to CIO immediately, if his NOC hasn't filled up yet. However do bear in mind that the current update of CAP is not quite current. It has a backlog and the update right now is of last week of Sep.

you mean the week before I sent mine? this means that in a week from now they me start working on "my" application (and the ones around that date?
