can't sponsor parents straightforward, what to do plz?

Greetings everybody,

I am a silent member of this great forum,I been reading a lot of very informatative threads which helped me to get a PR status ,especially the legend Qorax.

Unfortunately, my story living in canada is not bright at all,since I am jobless since 2 years and exausted 90% of my funds,anyhow....i am trying these days to bring my folks from uae to canada, and after reviewing cic rules regarding parent sponsorship, it appears i don't fit the requirements since i dont have a job, so i have the following inquiry plz.

1- my parents are financially healthy back in uae,both of them still work and they own a freehold apartment in dxb, so what if my parents transfer the required minimum financial fund to sponsor parents through super visa,The low income cut-offs LICO, or even little bit more than the LICO, to my bank account,and I show this fund to CIC in my super visa application...will it be accepted. is there any such precedence in this regard.

2- i am thinking to ask my relative who is cousin to my mother,to send her invitation letter and so my folks can apply for a TRV, however from reading some threads here , i found out one of the reasons to get rejection is Canada home ties,so i was thinking if my folks apply for a TRV online and don't mention that i have a PR status would CIC find out about this and how would they know?

3- what would u advise me to overcome this situation..!!. is there a way to bring my folks here, i am their only child,and they r elderly and about to be on pension becuz of age,and they can't go back to our home country becuz of civil war .i tried to apply for Humanterian and compansionate cause but i found out that parents have to be inside canada to apply for H&C....!!...i am under big stress becuz of this...plz help.

1. The short answer is no - absolutely not. LICO is based on income (what you are making by working) - not the balance or savings in your bank account. So no - there is no chance this will work.

2. Your parents have to mention you and your PR status in their application. Failure to do so is misrepresentation (lying in an application) which will result in the application being refused and a 5 year ban from entering Canada. CIC will most likely catch the misrepresentation since you would have included details about your parents in your own PR application and all of this information is saved to CIC's central database. If CIC doesn't find out about the misrepresentation during the TRV application - then they will find out later when you either try to sponsor your parents for PR or apply for H&C - they will then be hit with misrepresentation and told to leave Canada (or even removed) - and then banned for 5 years. Once they have been charged with misrepresentation, you should expect CIC will never again approve them for any kind of visitor visa (either TRV or super visa). Don't lie - it's a crime and will create even bigger problems than you have today.

3. Their only option at this time is to apply for a regular tourist visa (TRV). To be approved, they will need to show that they have strong ties to their home country and have no plans on remaining in Canada long term. They will also need to demonstrate that they have sufficient funds to pay for their trip to Canada.

I don't understand, you're wanting your relative to apply for a TRV for your parents, but at the same time they don't want to return home to their country? So does this mean you plan on applying for refugee status for them?

if u don't understand then u can ask,instead of making wrong assumptions.!

my relatives will send letter of invitation not TRV ,since I am unemployed so I guess my relatives have stronger case to send the invitation than me since they work and have house.

my parents will not overstay their visa if they got it, but i asked a laywer and he said to file a H&C case ur parents have to be in Canada,and since they r working try to apply for TRV,and once they r here they can apply for H&C not refugee,once they apply for it ,they will leave becuz they still work in uae and their vocation cant be longer than a month .

In that case there is no point applying for H&C - you are guaranteed to be refused. To be approved for H&C, your parents will have to prove they have reasons why they must be allowed to remain in Canada. If they apply and then leave - they will be refused because it will be very clear to CIC they are abusing the H&C process. If they want the H&C application to have ANY chance of succeeding, they need to remain in Canada for the entire time while the application is being processed. If your lawyer didn't tell you this, then I would recommend you get a new lawyer who knows what he's doing and understands Canadian immigration law.
