Cannot file for Spousal Sponsorship if I am outside of Canada ?

Hi,

I am 27, Canadian PR and currently on a trip to India to get married (Work is also continuing from India). My Wife to be is living in India.

I am getting married on 25th Jan and plan to file spousal sponsorship soon. My agent is telling me that they can only file it as soon as I land in Canada. My plan was to stay till April in India so that I can skip the Winters and thus, plan to file Spousal PR in January end. However, my agent is telling me that I need to be physically present in Canada to file PR.

Obviously, I am staying only for 4 months in India and thus, my permanent residence will be Canada only.

Please tell me if this true that I cannot file PR in January end (soon after marriage) and have to wait till April (the day I land back in Canada)

It is true. As a PR, you cannot sponsor anyone while living outside Canada. As PR, you must reside and remain in Canada in order to begin sponsoring anyone. You must remain in Canada during the whole PR process from start to landing of sponsored PR.
