Hi,

I have Been invited to apply under Canadian Experience Class.

I am currently working full-time and have just over 13 months of Canadian work experience under the same NOC code. I currently work for a company as a full-time permanent employee on an annual salary for the past 7 months (40 hr/perweek), with the first 3 months with the same company as a full-time hourly employee (40hr/per week). The other 3 months I worked for an engineering company under a Personal Services Agreement (contractor agreement). I worked at the company office, used company computer equipment etc. I have a Employment letter from them which states I was in a personal services agreement, my title, dates employed, duties, hourly pay and average hours (37hr/per week).

Will CIC treat my 3 months engaged in a Personal Services agreement as full-time or self employed and therefore towards my 1 year experince?

Or considering I have 90 days to submit my application, should I just wait 2 months until I have 12 months as a employee at one company?

PSC is "self-employed," so that experience (most likely) will not count. Since you don't meet the minimum requirements at the time of the ITA, you should decline the invitation until you have at least one year of employment experience.

You can, of course, apply anyway if you want to take the risk. If you do, you should include a letter of explanation about why you think in your first job you had a de facto employer-employee relationship. Just don't be too surprised if it is refused...
 
Thanks for your response. I have declined the invitation and will wait, I will make sure I tick the self employed box this time in my profile. Will I qualify under "Skilled worker" as you can use self employed experience, even with the 1 month gap between jobs I have over a year? I have read it doesn't have to be 'continuous work' they changed it?

For FSW, you have to have one year of "continuous" foreign work experience in the same NOC.

For CEC, the one year of work does not have to be continuous or the same NOC.

This has not changed.

Work experience in Canada will not count as "foreign work experience" and so you will not meet the requirements of the FSW program.

Does the 1 year continuous full-time work need to be in Canada? I have over 8 years of work experience under the same NOC code. I have held a position as an employee for a continuous year prior to moving to Canada, this was in Australia.

Um, for foreign work experience, which is specifically NOT in Canada? : )

Well, if you include your foreign work experience in your profile, you will not only get more points, but also likely qualify for FSW (whether you want to or not is another matter - the CEC application is much simpler, and you don't need to show "proof of settlement funds").

Keep in mind that for any job you include in your profile, you will need to show proof- e.g. get a letter from your former employer and supporting documents.
 
When I completed my profile I qualified for both FSW and Canadian Experience, however after the fact I raelised that one was self employed , therefore my ITA was for the CEC. I have now updated my self employed work experience and made sure I tick the box for this, I already had all other work experience listed and proof of funds. So it should only show I qualify for FSW now.

I have letters of employment from all previous employers as per the CIC instructions (Company letter head, hours, salary, duties, title etc). Do I also need additional documents for employment proof?

Any corroborating documents (tax documents, like T4s for Canadian work experience) make it a lot easier for the VO to accept the work experience.
