Cancel Spouse PR after approval

Hi there,

I am a primary applicant of our PR. I came to Canada as a student some 5 years back. After graduation, I got my work permit & applied for PNP in my province. As soon as my PNP is approved, I got married.

This is an arranged marriage. Since I got my PNP, me & my wife applied PR together. It took 1.5 years to get our PR approved. From there my head ache started.

Now it’s been 1 year since we got our PR. She move to Canada as soon as her PR got approved.

We are not in good terms. I am willing to go for divorce, but she is not. Now I am thinking to cancel her PR & sent her back to India.

Is there any possibility to do so??.
Anyone please help me.

PR wont be cancelled unless and until you show that she committed fraud with you. Chances of cancelling are rare as you have been living with her in Canada for more than an year now.

Any chance that her PR will be canceled? No - absolutely no chance.

She is entitled to keep her PR status.

If you have sponsored someone to come to Canada as your spouse, the sponsorship undertaking that you signed remains in effect for three years after the person becomes a permanent resident, even if you separate or divorce during that period. You are responsible for the basic needs of your sponsored spouse throughout the duration of the sponsorship undertaking.

As Simran mentioned above unless you can prove she married you as fraud just to get into Canada then you can contact CIC and have her PR revoked.
If you can't prove it and divorce her, you will end up covering her living cost.

Since you applied for PR with her, you didn't sponsor her PR. So there is no undertaking signed. Filing for divorce has no effect to her PR status.

If you reported that she applied via committed fraud with you, if IRCC investigate and found that true, your PR may be revoked too. Because both your PRs are applied in one application.
