Cancel PRV???

My wife successfully got her PRV and we've been living in Canada for 3 months. We're not quite sure if we will stay in Canada or if we will move back to Taiwan. If we move back to Taiwan and cancel her Permanent resident visa is there any fine or punishment? Would she still be able to visit Canada later? :eek:

Your wife can leave Canada and live somewhere else. She only needs to be physically in Canada for 2 out of 5 years to maintain here Permanent Residence.

Hi Almostkewl, there is no fine for abandoning your residency however you may have to reapply entirely if you do not commit to 2 out of 5 years as kelkel said above.

As permanent residency is a difficult process, you do not want to cancel or 'lose' the PR.
Save yourself the hassle, the money, the trauma and do not cancel your wife's pr. She can spend time out of the country. Just not all of it!
She needs to ensure that she stays 2 out of 5 years in Canada.
Plus, the Government wants to institute temporary permanent visas for spouses and i assume this will be done later this year. So if you have the permanent, try to ensure she keeps it.

There is no need to cancel the PR visa. She can enter and leave Canada. She should stay for 2 years out of 5 to keep her PR status.
But: If you are a Canadian citizen, time spent with you outside of Canada counts as part of her residency requirement. So the two of you could go live in Taiwan, she could maintain her PR status, and she could use the time spent living with you in Taiwan as part of the time required to become a Canadian citizen.

It is listed in the guide for Applying for a permanent resident card (PR Card) — Initial application, replacement or renewal.

I thought if you resided outside of Canada with your Canadian spouse you could still retain your PR but I also thought you had to be physically present in Canada for time to count for citizenship? I'm not sure but I'd like someone to clarify :)

You're right kelKel. You can maintain PR if you are accompanying your Canadian spouse outside of Canada. Obtaining citizenship requires physical presence in Canada for 3 out of the previous 4 years from the date of the application.
