It has happened to many, as per the followup I have done in this forum. The express entry is providing the points for Canadian work experience one month earlier. That is 11months 1day, EE is giving 36points considering as 1year Canadian work experience. 1year 11months and 1day is considered as 2year Canadian work experience and its providing 46points.

Nobody knows whether its a system error or its a CIC programming. But this is consistently maintained for everyone.

In my case I started working from August 2013. I got 11points extra on 1st July 2015, because express entry is thinking that I completed 2year Canadian work experience.

I got ITA on 17th July 2015. I still have 13days short for 2year at the time of ITA. But at the time of eAPR I would have finished my more than 2year Canadian work experience.

Now i have two option, either to refuse or accept the ITA

If I refuse, then if the CIC programming is like this, then I will be wasting my ITA.

If I accept, Then definitely its not misrepresentation, But one possibility is it can be a system error of providing the scores. CIC may not accept ITA. If CIC informs me after 5months then its a big waste of time.

I am planning to call CIC to enquire about this before submitting my application.

i got you . so your situation is same as mine. also keep in mind, as per the cic eligibility "Full Time" of work is actually goes like this.

30 hours/week for 12 months = 1 year full time (1,560 hours)

and if we are working 40 or more hours of work per week, we are able to attain the 3200 hours ( 2 year ) in one year 8 months.

Agree with you on this. You can not be charged for misinterpretation. But possibility of ITA cancellation is there though very remote in my view.

My personal view is CIC has intentionally done this. You should be fine if you submit the app. CIC has implemented date for personal history it was not so difficult to that for employment. Nowhere CIC has mentioned how the calculate the year for points (though they have a very clear instruction for CEC qualifying experience).

Do let us know post your call to CIC.

My Canadian work experience is also like 11 months 2 weeks.
System has not only awarded me 40 points for Canada work experience, if you see this also counts towards skill transferrability.
And, me as applicant don't have this facility to ignore my Canada work experience . I have to enter details asked for. If i don't enter that would be misrepresentation :o :o

If Canadian work experience is not considered, my points take a plunge from 476 to 398..

Please let group know what CIC say on this issue.

Thanks

Now I am just stuck . I can't even remove my 2 months work experience coz then I would be lieing . Can't accept my ita because I haven't completed my 2years of work yet. Don't know what to do

I would suggest make sure that qualify for FSW so that you get ITA for FSW. I think if you submit the app under FSW you will be fine. Even if you consider there is some risk of rejection, for you it may be worth taking the risk as the point not likely come down to 398 soon.
