Im new here. I'm a Canadian Citizen and planing to marry an US citizen. I would like to know if there is any benefit hiring a immi lawyer or just do it ourselves.
I want to make sure the right steps.
Should we marry outside Canada (US) and then I come back to Canada and US spouse stays in US and applies for Perm Residency from US ?
How long does it take ? Is it faster if you hire a immi lawyer? Any suggestions ?
Or marry in US then both come back to Canada and apply from within Canada?
Will they let her in? I heard that if you marry US citizen US won;t let you in US because they can't legally kick you out of the country.

Do I have to apply for her in Canada or is the entire process done by her application from the US ?
Where does she go to fill out paperwork in the US, on line, Canada Consulate or Immigration ?
Will she be called for an interview in the US will I be called for an interview in Canada asking for proof where we met etc etc ?
if any one has done it please share your info with me. Thank you

Thank you! What is the wait time once you apply ? I hear 2 years but some other people say 10 months.

If you apply from within Canada (if she's living with you in Canada during the time) you are looking at about 19 months but if she returns to US and you apply to sponsor outside of Canada, you are looking at approximately 26 months. Should she return to US when you submit a spousal sponsorship application, she may then require a visitor visa to come across to see you (as opposed to not requiring one when US citizens normally cross the border).

Its always a good idea to have a strategy before choosing how you will apply (inland or outland) so that you are aware of exactly what you are getting into. For example, outland applications are the only ones that allow for an Appeal of a negative decision whereas with an inland application, you give up the right to appeal a negative decision (most often, people opt for the inland option because of the shorter processing times).

Please be sure to know of all details reqarding the sponsorship stream before you decide which way to go. And, always be sure to hire a consultant who is authorized to help you so you avoid being ripped off.

UM NO! This information is WRONG! Current US applications are being processed in 5-7 months. US Applications go to OTTAWA, NOT LA for processing, as i am assuming you are quoting the US processing time on the CIC site. Also, US citizens will NEVER need a VISA to cross as a visitor, no matter if they have a PR application in process or not. That makes absolutely no sense. VISA EXEMPT IS VISA EXEMPT!!! Kindly refrain from posting any sort of information if you are not familiar with, especially if it involves crossing the border or visa office processing times.

The BEST OPTION for US applicants is to apply OUTLAND. If you choose to appy inland, you will soon regret it, as it takes 1.5-2 years to finish processing. As stated above, US OUTLAND applicants are getting processed quickly.

An OUTLAND applicant does NOT need to be outside of canada to apply. If they choose to stay in the states, that is completely ok. They can also send in their application and remain IN canada as a VISITOR during the application time. If need be, they can extend their stay as a visitor to remain in canada throughout processing. A visitor can NOT work, so Outland applicants are not eligbe for work permits. The applicant CAN work remotely for a NON CANADIAN employer while in canada as a visitor.

It is suggested the original poster joins the FAMILY SPONSORSHIP thread on this forum to get the most accurate information. We have spreadsheets that track progress and trends for US applications in OTTAWA.

Also, for the most part, applicants have NOT found attorneys or consultants to be of any value, and in my opinion are a waste of money. From what is posted on this forum, it also appears they tend to give out really bad information and advice about the process. You are more likely to get better insight on this form because we are all going through the process, or have successfully completed it.
