OK here it goes..

I was wondering if any one can advice on the following:

I have had my PR status cancelled upon entry into toronto Airport, (sad) BUT i am slightly confused...

I have been accompanying my husband ( a Canadian born citizen) while living outside Canada ( living in the UK)

I have read that if i am accompanying a Canadian citizen abroad it should not be cancelled ? is this true and can i appeal this cancellation?

Can any wise folk advise on this crazy situation?

1. When you say cancelled can you clearly describe what happened?

2. Did you sign any paperwork at the airport and do you have a copy of what you signed?

3. What date did this happen?

4. What date did you land in Canada as a PR and how did you get PR?

5. What date did you get married and what date did you start living with your Citizen spouse?

6. Do you have a valid PR Card? Did the border agent take any documents away from you?

7. Are you a UK national?

However, from your previous posts, it seems that you don't have PR status yet since you were saying that you are in the process of applying for your PR??? Is this true???

In light of the previous posts under the OPs' username, this post makes no sense.
Previous posts indicate that the husband is a Canadian citizen and the wife has not yet received PR from FC sponsorship. Confused...

At immigration they politely advised me that my PR status has has been cancelled due to not being in canada for the req amount of time - that is all they said. ( I was traveling on a UK passport)
no paperwork was signed
this happened in April 2013
I landed in Canada in 2001 got PR status through "in canada" process in 2001 nov
married in 2001 oustide canada april 2001 l.
board agent did not take anything from me I still have my PR document and I have not gotten the PR card due to the below. ( I have not applied)

all previous post are me looking to re-apply all over again, ( starting process over etc )

As things have changed sooooo much since 2001 .. yikes i need to know how i can do it properly.. remember in 2001 I did PR process in 7 months in canada today it takes upto 2 years i am told.. ( sometimes less

plus i have kids..so the situation is now slightly complicated

While reading the cic website yesterday i read that you can be outside canada with a canadian and not lose the citizenship..

does it make sense?

Your PR status cannot be "cancelled" at the border. You can be reported, to which you have a right of appeal.
If you didn't receive a notification of being reported and you didn't sign anything to revoke your PR status, you are still a PR.

Serious.. how does one go about appealing the cancellation? ( or notice of cancellation)?

so there is hope afterall .. do i need to contact the CIC or embassy? etc?

Wow this is a bright light of hope... wow.. Halleuia.. finally some light :)

I was so shocked by all the new changes in the cic process :)

You need to answer the initial question that you were asked in this thread. Be VERY detailed because I think you may be missing out some vital part of the story. Then, we can help you. Were you given ANY paperwork at the border? If so, what does it say? Has CIC contacted you at all since?

What is this notice of cancellation you refer to if there was no paperwork issued? It appears from your response all this was a verbal discussion at the airport. Was this conversation at the first agent you were directed to or did you go to a second room as directed by the first agent? Did you tell the agent about your Canadian citizen spouse?

Just to be clear:

At the border the agent ( canadian custom agent) advised me that "you have lost your status and i have been formally told that i no longer have my PR status as i have been away from canada too long" - I advised her that i have been abroad with my husband and she said that it does not matter, ( very politely)

no paperwork was signed - no second interview - nothing else was done. I simply assumed that my PR status had been revokes/lost etc.

I hope this helps..?

where does this leave me and can anyone with experience advise me if i should appeal or maybe even seek legal help?

It's very clear from that response that the border agent was talking complete rubbish.
You have not lost your status and you are still a Canadian PR. There are mechanisms to get this confirmed if you wish but the quickest way is to apply for a PR card renewal using the normal process. As long as you can show that you were accompanying your Canadian spouse, there will be no problem. You don't have anything to appeal against.

Ok so there is a high possibility that my PR is still active even though I have been warned - let me ask a fundamental question/

As a PR od canasa is it true that while accompanying my Canadian husband I will be covered as being in Canada? - the reason I ask is that the agent at customs said that "it doesn't matter" ( in response to my reply that I have been accompanying my husband while outside Canada)

Is any one qualified to help out with this question?

When you apply for the renewal of the PR card, you would have to provide supporting document that you are living with your Canadian spouse outside Canada.
