Hello, I have a question on Canadian Permanent Residency under FSWP with Express Entry. I am currently in US and my H1B application got selected in lottery. Currently, my H1B application is under process. Meanwhile, I want to apply for Canadian PR. My question is -Is it okay if I apply for Canadian PR when my H1B is under process. Does my Canadian PR application affect my H1B processing? Thanks in advance.

It does not affect your application in any way. I am already on H1B and have a pending EB1 green card application and from what I've learned so far, it shouldn't affect your canadian PR application.

Thank you for your reply. I am sorry I was not clear.
My H1B got picked up in lottery this year and it is under process of approval.
I meant if I create an express entry profile and go ahead with the Canadian PR process does that affect the H1B approval process?
Thanks in advance.

Oh ok, of course not. There is no way USCIS can know you are under Canadian PR process. At this stage you haven't even created an express entry profile, you haven't begun the Canada application so no, there is no wah H1B will be affected by it, if you start. The only issue you might have sometime down the line is getting a reference letter from your prospective employer (the one filing H1B on your behalf now), but that has nothing to do with USCIS.

I ordered my GCMS notes.
And the first thing they did before even started reviewing it was to notify the US.
Just saying.

Notify the US of what? Who notified US? Who did they notify, USCIS? I'm confused, why would CIC notify the US if you request GCMS notes?

Well, just because Canada and the States share certain information regarding immigration, it doesn't mean it will affect the application in any way. But yes, they do know if you're going through immigration in the states.

IRCC notifies the states about my application. It's prolly due to some agreement on information sharing.
They have to disclose the act of sharing info on GCMS notes, which I have discovered later after getting a copy of the notes.

Thanks vzoo that's very interesting. For H1B pending, I don't see how that should be a problem (this is referring back to OP's original post).
In my case, I actually have a pending green card application in the US, if IRCC is notifying US that might be an issue. I'll look into this

To OP: I recall that on this website there is a sub-forum called "H-1B Holders in the U.S.". Look under the "Immigration to Canada" forum. There you will find useful information on the issues with Canada PR application while on H1B. One of the most recent posts is by someone who got Canada PR while on H1B. So that shows it can be done.

Thanks vzoo, that's useful!! I did not know that. I'm glad I found out now as opposed to later.

Thank you so much for your inputs. If this can help, I also asked some lawyers about my question online. They said it should not have any effect, but I will still look into it.
