I came to the US in 2004 on a trip and met and married my husband who is a US citizen. I never have crossed the border back into Canada since that day I came in. At the time Canadians did NOT need passports to enter, so I didn't have one. I have since obtained a Canadian passport last year. We have a 2 year old son and now we want to move back to Canada. My first question is this: Is my son considered a Canadian citizen since I am one? and what kind of paperwork would I have to fill out for him? My husband has a misdemeanor pot possession charge stemming back from 2003, will that affect him in any way in becoming a Citizen of Canada? It was NOT a felony charge. How long will this process take? What is the process, do we file and then get his PS eventually? Or will we have to go to a US embassy here in TX to do an interview? I don't know anything about any of this and it's all so complicated and of course everyone's situation is different. If anyone can help, that would be great

Your son is a Canadian Citizen by decent. I'm not sure of the paperwork that goes into that... I took a quick scan on the CIC site, he would def qualify for citizenship under that category. I think you jsut have to get him a passport.

1. The OP has to apply for proof of citizenship see: http://www.cic.gc.ca/english/citizenship/proof.asp After she has applied for proof of citizenship (during the process, don't have to wait for completion) she can apply for a limited validity passport. See: http://www.cic.gc.ca/english/resources/manuals/bulletins/2009/ob154.asp
