Hello ALL,
If you work for a canadian employer through an agency on a long contract 1+ years would that qualify for CEC?

would it matter if you are incorported or not?

what if you are not incorporated but you still paid your own taxes?


I hear alot of ppl telling success/fail story and I am confused ....even Lawyers have different opinions on this?

please clarify and share success stories if any?

It's generally considered self-employment. CRA and CIC both see it as self employment.

I was not incorporated and worked on a contract for a company. I was rejected in 2013 because my experience was considered as self employment. There was no placement agency involved, so I am not sure about that. I had a contract directly with the company I worked for.

I agree. If T4 was issued to you then it might be considered that you were in employee-employer relation while you were working. I am not sure but Section of "Request of ruling" from CRA might be helpful to you to prove that you were in employee-employer relation. Go through OP25a: Bulletin 10.12 (Page 10-11). http://www.cic.gc.ca/english/resources/manuals/op/op25a-eng.pdf

This couldn't be answered much simpler than this... I agree with Scylla....

OP.... Unfortunately, you wouldn't see much success applying under CEC....

I have a little experience in this area. You do not have to incorporate yourself to be considered self-employed by CRA.

To be considered an employee, there must be a direct relationship between yourself and your employer. You can be employed on contract and receive a T4 salary, or you can be a contractor that only bills for services.

How did you get paid?

I have been sub-contracted by a placement agency "company" to work for their "client".
The placement company agrees to deduct CPP and EI and will send T4 at year end.
Does this relationship between the placement agency and me entitle me as self employed or as an employee.

I work in a Placement Agency.. and what I know is that if you are incorporated, you are not an employee of the company.. but if We as in the placement agency plays for your taxes, you are an employee of ours...

So as far as you are getting T4 and the agency is paying taxes for u, you are good..

How are you paid? Do you receive a T4 from the placement agency each year? That is really key.

It is an employee-employer relation as T4 is being issued to you and more over CPP and EI will be deducted. EI is not deducted for those who are self employed.

I am paid via direct deposit and will be issued a T4 by the agency.
They are asking me to invoice the hours to them. I dont see the reason for invoicing because that makes me self employed (i guess so).
Well I have talked to the Sr. Manager and they term it as only internal and nothing to do with anything else.
They agree to write a letter with all the specifications demanded in the CEC employment status checklist.

I have applied under the same process, and i have seen enough people being accepted and became PR when applying through a employment agency as a contractor.So you are eligible
