Hi All,

I have moved to Canada as of Sep 2018 with a Closed work permit and my WP expires as of July 2020 . Recently with my English test results and Valid job offer i'm able to get a CRS of 475 (Along with Spouse) .

With respect to Job offer , I only have the details submitted to IRCC at the time of applying the CLOSED work permit which I believe IRCC might not consider as the WP is going to expire in 7 months . I got a separate letter from my manager listing my overall experience in India and In canada with the roles and responsibilities . Same is also notarized .

Can someone guide me if I need to get my work permit extension first before applying PR so that I will have a document for JOb offer ? Current employer will not give any such letter at this point for IRCC purposes . So i just have my manager's signed letter with Roles and Resp. as a proof for Canada and India experience but I think it is not sufficient to say as valid job offer and claim 50 points .

Please advise what is the best way to proceed now ? ANy help is greatly appreciated .

Hi Guys,

I have few concerns about about experience class,

  • Can I apply for PR after completing 1560 hours before completing 12 months (As a skilled full time skilled employee)?
  • Do I have to have a skill category job related to my education background?
  • What are the documents required from the employer for this process?

A) 1560 and 12 Calendar months is a must.
B) No not required.
C) Minimum requirement is a work experience letter that has the roles and responsibilities, salary, benefits, full time/part time, dates of employment and any other information deemed necessary. You should also supply T4's or payslips whenever available.

Thanks for your reply. Can you confirm what documents is must for a valid job offer? My current employer won't give any such letter as they have replied the same via email . So the notarized letter from my manager with roles and responsibilities, hours per week , salary will be enough for a job offer ? The only letter from my employer is the Offer that they gave to IRCC at the time of WP processing (Dated July 2018) and the WP expires by July 2020 ?

Please help

I am not sure about the requirements of valid Job offer. I believe some would say your employer needs to do an LMIA first.
Guys any thoughts ?

To get the 50 points for having a valid job offer, you would need either

A) a new positive LMIA that approves the offer and names you and your position OR

B) your current employer gives you a new written offer of a full-time job for at least one year after you become a permanent resident.

No, you have to complete a full year (52 weeks) of full-time work (or the equivalent in part-time work) to be eligible.
  • Do I have to have a skill category job related to my education background?
In general, no, but there are exceptions - it depends on the NOC of the job.
  • What are the documents required from the employer for this process?
See the section, "Proof of work experience" -

Thank you for your reply.

This T4 tax thing, do I have to provide only from current employer right?

Is there’s a general format for getting job duties, benefits, etc on company’s letter head, to prove that I have worked as a skilled employee there for one yr?

Do I have to get a separate letter from employer to prove that I have a job offer?

You should provide for all work experience in Canada for which you are claiming points.

Not so much as a format, but required information - See Proof of Work Experience -
https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/permanent-residence/express-entry/applications-received-on-after-january-1-2016-completeness-check.html

Generally, yes, it requires different information. It is possible to combine in one letter, but you would then have to upload the same letter to both place holders.

Having a work permit is not equal to a job offer. A job offer to claim the 50 points, must be a letter from whomever will employ (or continue to employ you) once you become a PR. If you cannot get that, there is no way you can claim those 50 points.

However, if you have a contract signed for an additional couple of years, you should be able to claims those points based on that, otherwise I would not count with those 50 points.

I came as an international student & currently I am on my 3 yrs work permit.

So hope my employer do not have to provide a LMIA for the immigration?

Thanks again.

Unfortunately, because you are on an open work permit, your employer would need to get a positive LMIA for you to be able to to claim to have a valid job offer.

Seems like I am in trouble in this case, coz I am 100% sure that they will not provide me a LMIA coz they have to spend for that.

I am 32 now & without the job offer I am getting only 440 points :(

Hey same. I was an international student and right now on PGWP for 3 years. How do we choose an NOC code ourselves?
