Canadian citizen wants marry illegal tunsian in US pls need advice

Hi ,
I am talking with a guy from Tunisia .He is illegal in US. I am going to marry him. If we will marry on Jan 2015 and start the process then how long its going to take for PR? Please , need advice. Do he has to go Tunisia for interview? How long its going to take for PR?

His file will have to be processed through the visa office that handles Tunisia applications which is Paris (not through the US) since he has not status in the US. If an interview is required, it will be held in Tunisia and he will have to attend in person.

Paris has fairly short processing times. However since the guy you have met is in the US illegally, I think you should expect longer than normal processing times since CIC will likely examine his application more closely to ensure your relationship is genuine and he's not just using your marriage as a means of remaining in North America. Hopefully you have met this guy at least one before in person before you plan to marry him. If not, you should visit him at least once before marrying him - otherwise this significantly increases the changes CIC will think this is a marriage of convenience.

Hi Scylla , first thanks for reply . I tried to check but still I am confuse. Its shows its going to take 6 to 9 month? Am I right? Please , let me know about time frame. Also , after application submit which office going to do next process?

80% of applications are processing in 8 months or less. However given your boyfriend's illegal status in the US, I would suspect your application is going to be in the 20% that take longer to process. How long no one here can say.

You must mail the application to the Mississauga office. Mississauga will forward the application to Paris once they have finished their review.

You said you are talking with a guy from Tunisia. Does that mean you have not really met him ? If that's the case, I really want to suggest as Scylla did that you make a trip to meet him before you make the decision.

As Scylla told you, his PR process will have more chance to take longer time due to his illegal stay in US. Nobody can figure out how long it will be.

i met my canadian wife while living in the usa on an expired student visa. It had no effect on PR process. As you can see i got my PR within 6 months outland(my application was sent to africa at my home office. I didnt get an interview, or request for anything) As long as you are genuinely married , and have proof to back it up CIC will process you equally as anyone else. I know many others that were out of status in usa and got PR without any flags. CIC doesnt care about your status, only criminal records, and your health, and if marriage is real. Prepare a very well organized application, provide lots of evidence of on going relationship, and you should be fine. Remember true love conquers all. If thats the reason for your marriage, you will be ok..all the best

I'm not sure if you've met him or not, but if you haven't, I highly warn you against it. I'm not sure if Canada gets the show 90 Day Fiance? Here is a link to TLC which airs the show in the US. The clip on the front page is from an episode where an older American women who brought over a younger Tunisia man to marry. It was very clear from the beginning that he was here for the Visa, because he didn't even want to have relations with her.

Also, keep in mind that Canada will make you 100% financially responsible for this man, for 3yrs, whether your marriage lasts or not. If he collects welfare, the government won't deny him, instead they will bill you for it.

I just want to throw in my 2 cents. If it's genuine on both parts, then the best of luck to both of you.

Talking with a foreign consulate isn't an easy task and they make it especially difficult to get in touch with the VO. Everything you need to know will be online, or in their manuals and publications section of their site: http://www.cic.gc.ca/english/resources/manuals/index.asp

Then another huge resource is this forum. There are also a lot of senior members here who know more than the average immigration lawyer and enjoy offering their help.

Now , I am worry if CIC think our marriage is not based on real love. If you don't mind may I asking what's going to happen if they think this is marriage of convenience? He has to go his country for interview? Or they will call us for interview together? what could be happen?

Yes - he would have to go to his country for an interview. Note that once he leaves the US he will be banned for 10 years and won't be able to return to the US until this period of time has passed.
