Canadian Citizen going home

Hello Everyone,

I am brand new to this site, so I really appreciate all the help I know you can give me.

I am a Canadian Citizen living in America, I came here in October to get Married. My husband has been in and out of work, the job market is horrible, and to be honest I miss my family something terrible. We have been playing with the idea of going to canada. I know that myself going back is simple but I need to know about bringing my husband (I do like this guy, y'know having married him and all )

Is there anyway we can do this while remaining together? We originally filed for a k-1 visa to bring me to the US and we had to be apart through the whole thing and I just don't think I could do that again.

What are my options?

Basically, you should apply immediately for his PR status, with an OUTLAND application. He will need to do medical exam and police/FBI check. The application will be processed in CPP-Ottawa, and should take around 10 months or so (possibly more or less) to complete.

During this waiting time, he can stay in Canada with you as a VISITOR only. Usually US citizens get a 6-month status upon entry, and you can apply to extend this another 6 or even 12 months when that is almost expired. Or if you return to US and come back again, the 6-month status would reset.

During the time waiting for PR, he can't work legally in Canada. But could always stay in the US to work while waiting for PR to be approved.

You must however, show intent and your plans to return to Canada once your Husband has received his PR. His medical and FBI fingerprints must be done upfront and sent with his application. Depending on where you live, it will most likely be less expensive to do the medical in Canada. My husband had his done last week while we were there visiting family. I know what you mean by missing family. We have children and grand children in Canada.

Yes, you can stay in the States until the application is finished. However, as someone else mentioned, you MUST show / provide documents (proof) that the sponsor (you) will return to Canada after your husband's Confirmation of Permanent Residence (COPR) is issued.

Personal anecdote:

I'm a Canadian citizen married to a Japanese citizen. When my wife and I applied for her PR, we were living in Japan. For the application, I included some letters written (two) by family members about how they knew of my intent of returning to Canada. Unfortunately, Manila lost them, so I had to send more documents. This time I included:
1) Five letters from family members and friends (parents, cousins, neighbor I babysat for, co-worker in Japan);
2) An email exchange with my travel agent regarding flights;
3) Photocopy of my renewed Alberta Driver's License;
4) Bank statement from CIBC.

I also wrote an essay detailing our plan in Canada after our arrival.

Sponsor - $75
Applicant - $475
Right of Permanent Residence Fee - $490
Total is $1040. Plus the cost of medical, police checks, etc.
