Here is my situationI have been with my finacee now since 2011, I have recently filed for divorse from my husband , divorse will be final in August of this year. I have travelled twice since to meet with my finacee and spent 30 days each time with him .Wondering if we can start any forms now while waiting for divorse to go through? And also looking for advice on the fastest and easiest way to bring him to canada.. I am a Canadian citizen . he is from Libya Any info you guys can give me will be of great help Thanks

You can certainly start filling out the paperwork but you won't be able to submit the sponsorship application until you are actually married (or have lived together for a minimum of one full year).

So they are forms we can start as of now ? But cant sumit till we are married .. which forms are these and can I download them? We cant live together for 1 year until he is actually inside Canada !!!! This is all so confusing :(

I personally wouldn't start the forms until you're ready to turn them in because CIC updates their forms from time to time. We started filling out forms in October. By the time we got all of our police checks together in January, several of the forms were different. I would recommend reading them over to get familiar with the questions, so you can think about how to answer them.

amikety was right, CIC updates their forms and immigration policies from time to time due to fraud cases. You mentioned that you were with your Fiancee since 2011, do you mean you live together since 2011? If that's true then you can apply under Family Class - Conjugal Sponsorship. If not, then you don't have a choice but to wait until you received your divorce and marry your partner.

Living together is Common-Law class, not Conjugal. Conjugal should be used only when every other avenue has been tried without success. If they're able to get married after her divorce, Conjugal is not an option.

Ah ok, sorry for that, I think you have your own CIC Office. I don`t know that there`s already Common-Law Class I thought it`s under Family Class, my mistake.

Determine your eligibility – Sponsor your spouse, partner or children

Effective October 25, 2012, sponsored spouses or partners must now live together in a legitimate relationship with their sponsor for two years from the day they receive permanent residence status in Canada.

If you are a spouse or partner being sponsored to come to Canada, this applies to you if:

You are being sponsored by a permanent resident or Canadian citizen
You have been in a relationship for two years or less with your sponsor
You have no children in common
Your application was received on or after October 25, 2012

Still dont get the2 year living together thing . so if we marry . can he come to Canada or do i have to leave and live with him in his country for 2 years ????? I DONT GET IT

You can marry him and then sponsor him immediately.

The 2 year rule applies once he is a PR. If he is granted PR, you then must live together for at least 2 years or he can lose his PR.

This is to prevent fraud; sometimes, a foreign person will romance a Canadian, marry them, be sponsored, come to Canada and then leave their sponsor straightaway. Previously, there was nothing that really could be done to the PR in this situation. With this new rule, it gives CIC more power to revoke PR in these fraud cases.

As I said, this rule is to prevent immigration marriage fraud. If he left you a day before the 2 year mark, he could be deported; if he left you a day after the 2 year mark, he couldn't be deported.

So if you guys are "happily ever after", that 2 year rule doesn't change anything :). After 2 years, he is still a PR

I See ... Well I guess its just the wait now , Divorse wont be final till August .... I have been back in canada now only two weeks After spending 30 days with him , And it seems like a lifetime :'( But I have forgotten to mention that my recent divorse is from a man from America , which I Was sponering , He was here 4 years , will that effect me from sponsering the man I was meant to be with in the first place to come to Canada ?
