Hello Friends,

One of my best friends who is a citizen of India has received his ITA today.

As he is not good in English (can barely speak), so I am posting a question on his behalf.

He has a Canadian born baby with Canadian passport, while he and his wife are Indian citizens.

While filing out post ITA form, it asks a question :

Is your child included in the application ?

Should he answer it as Yes or No ?

I told him to go for 'No' as baby is already a Canadian citizen, but I wanted to double check with you guys as I don't want to take any blame later on.

Thanks

No, don't include that child in the application. Just disclose that information to ircc in the application.

If my friend doesn't include his baby, and it would show as non-accompanying, as I had been reading based on inputs on other threads. but baby is already in Canada. Is that conflicting info as per you ?

It's perfectly fine, I had a Canada born baby while my pr application was being processed. All I had to do was to inform ircc about the new born and didn't have to add her into the application.

I went through BC PNP category, so there was no ITA for me. The process was much more lengthy, the baby was born when my application was being processed.

But think about it this way, citizenship trumps permanent residency, when you already got Canadian citizenship why would you apply for pr?

Exactly going by logic, if someone is already a citizen why should he/she (the baby) be included in the PR application.

But the other part is accompanying or non accompanying.

So if he is already there with his parents (accompanying), selecting NO makes it non-accompanying

Isn't this tricky ?

The first "accompanying" is a physical reality, and the second "non-accompanying" is a legal term, I would say.

So just select the baby as non-accompanying is what your friend should do.

Perfect thanks for solving this immigration puzzle for my friend. Based on your answer i would ask him to go for a "NO"
