Canada Work Permit Outcome with Prior PR cancelled

Hi All,

Please can you help me out? I am really in a dilemma. On Aug 2008, I filed for my PR for Canada. The file was picked up by Canada Consulate on Feb 2009 and then they cancelled my request stating that I was ineligible for the categories mentioned by the amended law on Nov 2008( New Categories for Job Criteria) . I was eligible if the new laws were not put in place. They refunded me the money for the visa.

I recently got a job offer from Canada and they are willing to file for my Work Permit. But once they came to know that I had previously filed for my PR they are saying that it will mostly be rejected, as the consulate might not be convinced that I will leave the country after my Work Permit Expires.

Although my company is willing to go ahead and file for the Work Permit

My questions are .
1. Should I take any extra care for this kind of scenario, for eg should I show the consulate extra asset in my home country.
2. What are the chances of reduction in a situation like this?
3. If my Work permit gets approved will I be eligible for a PR after 2 years.

The work permit and the PR are two processes totally different. Anyone is able to apply for both at the same time and it's well recognized by CIC. Go ahead and get the work permit. Once you get established in Canada you may apply under FSW category 1 (38 professions) or 2 (permanent job offer).

elar is absolutely right....u should goahead....Canada welcome skilled people.....it seems to be very funny...my brother applied for study permit....and in telephonic interview...he was asked if he will return after studies nd all that....finally he got visa...and then along with visa..canadian embassy also provided him information regarding post grad work permit nd that he can also apply for PR under CEC nd all that

just a quick info about UK immgration, students here can apply for PR (OLD HSMP) and if the dont get it, they still apply for extention as student and they do get it,,, now visa officer can ask that you applied for PR now you saying after completion of you studies you will go back ???? but they dont,,, as its in immgration law that this is an option for students.... so i would say go for Canadain work permit, as they prefer local experience, which is mentioned in immigration as well,,,

Hi,
I'm not really sure of what you mean with extra documentation. But I'll suggest you to read and follow the steps in www.cic.gc.ca. You will not find a better source.

But if you mean suggestions, I'll give you two very important ones in my point of view:

1. Be aware both processes are different. For getting the work permit DO NOT mention your PR process or your intentions of staying permanently in Canada as Work permit is just approved to people who will stay in temporary basis only. So, for your work permit request, it is suggested to cap your stay in Canada and me sure it's really clear in your documents. Otherwise, you take the risks of getting it denied.

2. Renew all the involved passports (your accompanions and yours) before starting your processes. This definetely would save you a lot of headaches.

In application forms they do ask if you have applied for any type of visa in past, if you say no,,, remember they have got the record, BTW i wont hide anything and no way renew my passport as they have your D-O-B and all other documents/ details, dont go for short cuts, be honest.

Hi Romford, I'm not saying anywhere to "hide" information. First of all is being honest for sure!!!!. I'm just mean that both processes has not to be merged or confused as they are totally different.
If you have a denied visa before OF COURSE you have to declare that. And if you are applying for a work permit you have to cap your stay as is stated in the CIC instructions. Work permits are just for temporary residence only and you can not say that your plans are to stay in Canada as the requirements to get it is declare your initial intentions of staying temporarily.

And I totally agree if you already applied it is not convenient to renew passports, I made that comment for all people who will start their immigration processes.

It will not at all cause problem. PR application and work permit application, both are different. Please go ahead and file it.
1. Yes it will be an added advantage.
2. NA
3. Depends upon the rules and if current rules stay valid then you would be.

You can also mean while ask for an arranged employment offer if you can. It can help you file for PR but usually takes 6 - 12 months for PR.
