HI GUYS,

I HAVE QUESTIONS ON MOVING FROM CANADA TO USA.

1. When someone is on CANADIAN PER RESIDENCE, do they require to get visa to move/ visit USA?

2. When someone is CANADIAN (BY CITIZENSHIP), do they require to get visa to move/ visit USA?

3. And, does any CANADIAN can easily work for AMERICAN EMPLOYER, I mean H-1 visa is it required for him OR the rules for CANADIAN CITIZEN is same as other country people that a CANADIAN CITIZEN need to find an AMERICAN employer who can sponsor him to work in USA?

Considering 3rd question, as far as I know there is something called NAFTA that helps CANADIAN CITIZEN to work in america.

Please can someone elaborate in details for the questions above. it will be greatful of you.

Many thanks in Advance.

1. Yes a visitor visa to USA is required for Canadian PR if he is not from a visa exempted country for US.
2. Canadian citizen does not need a visa for entering USA. Show the Canadian passport at the boarder.
3.With TN1 visa a Canadian can work in USA. My knowledge on US visa rules are very little.

According to gathered information:
The process to obtain a TN1 visa to work in the US is the same as to obtain an H1B visa (you must first find a job with a US sponsor company). This means that many H1B employers and sponsors also recruit and hire people on TN1 visas. A TN visa job must be found and secured with a TN sponsor company in the US before the visa application can be submitted and issued.

Canadians looking for short term work permits should consider the NAFTA "TN" (treaty national) visa. The visa includes most professional designations. The TN visa is not designed for self employment. The visa is designed to accommodate short term employment in a professional capacity. Consultants must demonstrate that they are coming to the US to service a client, not to set up their own US business.

For expert opinions please wait for more replies.

Just to add...

For #2 - A Canadian citizen can visit the US as a tourist without a visa. However a Canadian citizen is not allowed to move to the US. If a Canadian citizen wants to move to the US, then they have to apply to immigrate to the US just like everyone else.

Canadian citizens are allowed to live in the US 180 days in a calendar year. Cannot work though. There are only a handful of professions which qualify for a TN visa. You could google the search phrase 'TN visa qualifying jobs' and check if your profession is on the list. If it is the next step as some one correctly pointed out is to find an employer willing to hire you. If you are hired, you could straight away apply n get the TN visa at the border. Be ready to show all your documents to the border control especially the offer letter from the US employer.

thanks guys for this answers.....

1. so, are there more companies in CANADA or USA. And, is it easy to get an H1 if you are in USA or is it tough.

as I have always seen that it is easy to settle in CANADA, that is, to get PRs but USA normally dont offer this service, you need to go and get H1 and then you get Greencard/ Citizenship, process takes around 6-8 years. and, now as i am seeing that everyone is applying towards canadian PR i am just slightly worried about future jobs.

2. And, what about the houses and food expenses in CANADA, is it more expensive than USA.

I have always heard that there lots of things are cheaper in USA from petrol to anything and quite easily affordable, but i dont have any knowledge of CANADA.

3. and, ofcourse last but not least, WEATHER, there is also a big difference among the weathers in both countries. does it effect some to get work to get to work?

The reason i have so many questions in my mind is because I have an option to apply to USA for further education but my application is in Canadian embassy indeed with Quebec's embassy as I have applied for QSW visa, i have received my AOR, but now i have an option to go to USA for further education.

DOES IT EFFECT MY APPLICATION WITH QUEBEC IF I CHOOSE AS USA FOR FURTHER EDUCATION?

I would like to thank you guys for reading the long document, but an advice from an ace players like you can help me to take right decision for my life.

Please advice.
