Canada dependent visa for child with developmental delays

Hi,

I am currently living in USA and is planning to migrate to Canada because of USA visa expiring.
I got open work permit and my husband got work permit stamped, however my daughter's visa is still pending with IRCC.

My daughter is 5 years and have overall developmental delays, so IRCC requested for her medical evaluation and it is completed with doctor. The evaluation is submitted to IRCC by doctor on July 12th, 2019 and it is still pending with IRCC.
We have gone through many similar threads in this website, however could someone please reply to my below questions and provide your suggestions.

1. Do we know how long IRCC would take to come to a decision for my daughter's dependent visa?
2. Since we have to migrate to Canada soon, can my husband relocate to Canada and me and my daughter go back to India, until we get a decision from IRCC and then move to Canada once we receive approval?
3. Should my daughter have to physically present in USA for visa stamping once approved? Can we send the passport along with other documents from India once it is approved?
4. Is there any chance of rejection of visa for my daughter, if yes, then what should be our next steps?

1. Unfortunately it's not possible to say. There are no standard processing times once additional medicals have been requested.
2. Yes.
3. No - you don't have to be present in the US. Yes - you can get your visas stamped in India.
4. Yes - refusal is possible if your daughter's developmental delays are serious enough that IRCC believes they will create a burden on Canada's health care and/or social care systems. If she is refused, then you may have to reconsider your plans to come to Canada.

Would also think longterm. If you are planning on applying for PR your daughter will have to go through another medical. Nobody can tell what will happen in the future to both Canadian policy and to your child’s health.

Hi,

Thankyou for taking time and replying back. For your response in point number 4 related to rejection, I found from canada immigration website that medical inadmissibility is not applicable for dependent children. link below. Can you please comment on that.

This exemption does not apply to you. This exemption only applies to situations where a Canadian citizen or permanent resident is sponsoring a dependent child through the Family Sponsorship stream.
