Canada Child Benefit 18 months calculation

Hi,
I am on student permit since September 2013.
My current permit expires November 2018.
My baby will be born this year November.
I filed tax return since 2014.
Just wondering how is this 18 months calculated? Is it continuous 18 months or accumulated?
I left Canada for one month this year in February and returned.
Am I still eligible for CCB?

So given your pregnancy you will no longer be in full time education ?
I might take maternity leave.
Still waiting for a definite answer from the graduate school whether this leave will affect my status.
Some say No, some say Yes.

I might be wrong, or perhaps we are talking two different things, but I doubt students are eligible for maternity leave. I suspect one of the conditions on your permit is you attend school.

Better call CRA at 1-800-387-1193 for better understanding of this eligibility rule:
You or your spouse or common-law partner must be:
--a temporary resident (as defined in the Immigration and Refugee Protection Act) who has lived in Canada throughout the previous 18 months, and who has a valid permit in the 19th month other than one that states “does not confer status” or “does not confer temporary resident status.” If this is your situation, do not apply before the 19th month

This was my thinking as well that the OP would no longer have any status by not being in full time education leading to possibly the study permit being cancelled but maybe there are other examples somewhere on this forum.

Yeah....that and the one month absence from Canada in February...I would think if you are on a permit and TRV, the clock would reset when you leave.

Are you eligible?
To get the CCB, you must meet all of the following conditions:

  1. You must live with the child, and the child must be under 18 years of age.
  2. You must be the person primarily responsible for the care and upbringing of the child.

    Note
    If a child does not live with you all the time, see Do you share custody of a child?
  3. You must be a resident of Canada for tax purposes. We consider you to be a resident of Canada when you establish sufficient residential ties in Canada. For more information, see Income Tax Folio S5-F1-C1, Determining an Individual's Residence Status.
  4. You or your spouse or common-law partner must be:
    • a Canadian citizen;
    • a permanent resident (as defined in the Immigration and Refugee Protection Act);
    • a protected person (as defined in the Immigration and Refugee Protection Act); or
    • a temporary resident (as defined in the Immigration and Refugee Protection Act) who has lived in Canada throughout the previous 18 months, and who has a valid permit in the 19th month other than one that states "does not confer status" or "does not confer temporary resident status." If this is your situation, do not apply before the 19th month.
    • an Indian within the meaning of the Indian Act.

You need to be sure that your school will report the absence as an "Authorized Leave"; this means that your study permit remains valid while you are on maternity leave. If the school isn't willing to do that, it goes down as "No longer registered/enrolled", which means that your study permit will no longer be valid after 90 days.

Authorized leave

The student has formally requested and received an approval to be temporarily absent from the institution, such as medical leave, maternity leave or any other type of leave where the student has a formally authorized leave by the DLI.

Note: If your DLI doesn'€™t track Authorized Leave, indicate the student's status as No longer registered/enrolled.

CCB eligibility goes by residency for tax purposes, not physical residency. As OP has lived here for several years, it can be safely assumed that she did not sever all ties and cease to be a resident for tax purposes during that one month absence.

The international office said maternity leave would not affect my study permit. But I will confirm with the department about "authorized leave".

As for the CCB eligibility. That's what I thought as well. But got confused with the wording of the 18-month period.
