Hello , My Dad received Canadian Visit VISA and will visit Canada on 17th of June and come back by November . Now we are thinking to apply for our visitor visa too (my mom, me and my sister) and fly to Canada with my dad again on the February of 2024 and then hire a lawyer and file a asylum case. How long can it take for us to get the permission to “legally” stay in Canada? What about work permits? Because it is quite impossIble for my family to bear the expense without a valid work permit in Canada . Can someone brief me in this? Also what Are the acceptance rates. And how much time does it take for an asylum case to finish and declare results. Will me and my sister still be able to study while there? (We are under 18) if yes, do we have to bear the costs? Thanks in advance

It generally takes around 2 years to be accepted as refugees. But can take longer or shorter as well. Each case is different.

It's hard to say for sure when you will have work permits. Some people are able to get them fairly quickly after claiming asylum and others wait over a year. There is no way to say for sure how long you will be waiting.

If you and your sister are studying at the high school / secondary school level, then you don't need study permits and there will be no cost to your studies in Canada. If you are studying at the college / university level, that will change and you will have to bear the costs.

It would be a better idea if your dad waits in your country till you apply for your visitor visa ,
Staying for almost 6 months in Canada, then coming back in less than 3 months could make the officer doubt if letting him in or what he was doing for 6 months here without applying for refugee while his family was in danger in their home country .. / other way is your dad applying in his first visit in Canada by himself and adding you to his claim, it could take longer for you to get to Canada but is also an option.

If you’re in highschool you don’t need a study permit.
Work permit waiting time varies , sometimes it comes before elegibility interview, sometimes even a year after it..


There is no way to say if you will get accepted for a visa, but you could gather all the documents showing you have strong reasons that will make you return to your country (job, studies, belongings , etc) and enough money to support yourself while you visit Canada .
Once in Canada you apply online or at a port of entry.

Do you have proof of persecution? You actually need concrete proof of persecution to get accepted as a protected person you can’t count on just applying and being accepted. What is citizenship and have you been living in that country? What is your reason for needing asylum? It may be very difficult for your whole family to get approved for TRVs. One of the reasons your father may have been approved was because his family was remaining at home. You father should claim asylum on his first entry or his return to a country will be a negative consideration in his application. If your father applied on his own that could mean 5+ years before you could come to Canada and there are cases of significantly longer separations. Have you looked at other immigration programs?
