Hello guys,

Please this is an urgent message and I would really be grateful for your helpful contributions. In one of my posts from a little while back, I explained to you how my lawyer incorrectly got me to fill out a sponsorship application for my spouse while out of the Canadian territory...something I had no idea could not be done and he probably knew better but refused to tell me because he was only interested in the money I was going to give him.


Now I am in a very complicated situation- the lawyer is refusing to take my calls and is not responding to my emails. I have no receipt and no tracking number to contact IRCC to either ask them to put a hold on the file until further notice or to cancel it completely. The lawyer isn't responding to my emails asking at the very least for an update to my spouse's file...which is my absolute right, given I intend to travel back to Canada very soon and all of this is going to have an effect on my family.


My question now is, should I try to see if I could get my wife to also apply for the Express Entry Program? Wouldn't that be complicated or impossible given the fact that she already has a sponsorship application file in progress that was submitted sometime just before the middle of the spring of last year for which we have not received any update? Interestingly, the lawyer in question is actually briefly in my country as we speak but is avoiding me- not taking my calls, not responding to my emails or text messages. I had the opportunity to see him inside a car from a distance when I was walking on the street. How do I follow up on a document for which I have absolutely no references- no tracking number, no confirmation of receipt, nothing?

If you a PR or Canadian Citizen, while not contact IRCC to complain and ask for help with your spouse's sponsorship.

Don't think you should start Express Entry Program application now until you resolve and is absolutely sure the spousal sponsorship was submitted and is in-process.

If confirmed your lawyer did not submit the spousal sponsorship, nothing stops you if you a PR or Canadian Citizen from Sponsoring your spouse.

OP is a PR, and PRs must be living in Canada to sponsor their spouse. The lawyer mentioned nothing about this to them so they submitted the application while outside Canada. So even if it is being processed, it will be rejected.

If the OP is a PR resident outside Canada, they could still sponsor their spouse except they must provide convincing proof in their application that they and their spouse plan to move back to reside in Canada else the application will be rejected.

The main problem now is the OP claims he does not not even have any confirmation the spousal sponsorship was submitted after like 8 months which i find very weird.

If confirmed the sponsorship were in-process, the OP could ask for a withdrawal to avoid refusal OR address issues like future residency which may negatively impact chances of approval.
No, this is incorrect. PRs *must* be living in Canada to sponsor their spouse. Only citizens can sponsor while outside of Canada.

If the OP is PR residing outside Canada, then there is no need to ask the lawyer as there sponsorship will certainly be refused as PR outside can't sponsor spouse "OUTLAND".

Now i see why the OP is considering Express Entry......So OP has to decide if to move back to Canada and then sponsor spouse or apply Express Entry for the spouse.

You gotit, Wakki. I intend to move fully to Canada early in the summer. The least I would have expected from the lawyer I used was to tell me the truth and to update me on my file and prepare me psychologically for the strong possibility that the sponsorship application will be rejected. Instead, he is avoiding me probably because of his conscience and what hurts is I neither have a receipt nor a tracking number to even be able to use that to contact the IRCC and ask them to either put a hold on the application or discontinue processing of the application until further noticeso that I can then restart the process after I return to Canada and get a job. The entire situation is so complicated. Even if I tried to press charges against the lawyer in question, he might lie that I never paid him or contacted him- after all, I have nothing to show as evidence. It's amazing the lengths people are willing to go to for money. Here is a supposed lawyer sacrificing his integrity and the truth just because of what he felt he could gain from me at that time. I now understand better why he is avoiding me but I'm not willing to let him get away with this.

Its really sad, the lawyer should have told you.........but like you rightly said........you wanna move on.........which is great.

When you get to Canada in the summer, advice you could start the spousal sponsorship process early as you really don't need to show bank account or have a job......please refer to the guidelines.......as a PR, you can only sponsor when resident in Canada.

If you could get a visitor visa to Canada for your wife, you could also sponsor her "INLAND", please see IRCC website for details.

You were earlier considering Express Entry for your wife......

The lawyer misled me into using a Canadian address on the spousal application form while I was applying outland and I do not want to put my own PR status at risk and find myself suddenly being accused of misrepresentation.

If you want to contact IRCC, thats okay.....but be very open, detailed and straight forward explaining your situation......that you are not quite sure the lawyer submitted the sponsorship but if he did, you intend to withdraw the sponsorship so as not to cause any future farm.

Can't even contact them on their forms online because they are asking for a client ID number and so on...which I don't have

Maybe try emailing them......or write a detailed letter to explain........and then followup with phone.

Can someone please kindly give me their email address and phone number? (IRCC) I was unable to find it on their Website and I need to act really fast for the reasons I explained earlier
