Hello Everyone,

I want to apply for FSW1 category under occupation 4131

I have more than one year of work experience as a College lecturer (physical education) and currently I am working as a Secondary teacher since April 2001.

The college has issued me work experience certificate mentioning I have worked with them as a Lecturer during academic sessions 1999-2000 & 2000-2001. I actually worked with them in two parts from AUG1999 - FEB2000 & AUG2000 - MAR2001 so as you can see basically I was on leave for 5 months during the period I have worked with them. Now my question to you all is, I was in employment during this break I took from college and they have mentioned on the experience certificate that I have worked with them for two academic sessions so in this situation, do I qualify under FSW1 category?

I contacted immigration lawyer David Cohen but he said NO but he also mentioned this is my opinion and a Visa offer's opinion could be different.........I think he said NO probably because I told him the truth?

What's your opinion guys? Should I go ahead?

as mentioned by you, two sessions means two different time period, which doens't make your job experience with them atleast one year countinious, rite?

this is the basic requirment for FSW1, you should check this condition for applying under 4131 as it would be part of 38 categories.

For your case if you worked for them and you were on leave for 5 months, then they should provide you the experience letter staying job period August 1999 to March 2001, this experience letter should also contain the detailed job responsibilities as mentioed for your category which is 4131

Read carefully the tabs "Main duties", "Employment requirements" on this page with other information.

If you can get the experience letter and your job responsibilies matchs as stated on this page, you should be eligible to apply under FSW1.

As i guess you might have worked in India, usualy colleges hire lecturers for terms and pay only for the term also.

legally, you cannot apply because it needs to be a continuous work for over 1 year.

but, your work-ex letter seems fine for you.. so, you may get away with it. show your first appointment letter. Make sure it does not mention that the employment is only for 1 session.

Two academic sessions means full time employment during two sessions without break.

I fulfil the employment requirements listed in NOC 4131 as I hold a master degree in physcial education (the subject I teach) but tell me one thing, do I need to ask College authorities to put main duties on work experience certificate?

It's been more than 8 years since I left my job of College teacher, I doubt they will write so much on experience certificate........so in this situation, what are my chances?

there are two main conditions:

1. one year of countinuous employment in you Job you rae claiming as in NOC. it should be min 12 months without any break, written two sessions and given dates of two sessions on your experience letter is
AUG1999 - FEB2000 7 Months
AUG2000 - MAR2001 8 Months

none of the above is 12 months, if you have the experience letter saying AUG 1999 to MAR2001, it would be better.

OR if you were also paid for months MAR2000 to JUL2000 and you have your payslips etc it can workout some how.

2. Main duties:

The visa office will check your experience against the duties mentioned in the NOC you are claiming, so it is recomended to have these written on your experience letter.

Hi Pankaj,

Thanks for writing. I have a new work experience letter from the college stating I have worked with them for 2 academic sessions:

1999-2000
2000-2001

This means I was employed with them and my employment was continuous. I think this will solve the purpose.

As for main duties, the college is reluctant to write main duties of my job on experience letter because this is not their as per standard format. Should I write & attach an explaination letter with my applcation describing the main duties I performed there and also write them that my College doesn't provide such document....will this help?

you might get away with this.
Only in the case they decide to do an inquiry at the colege and the college says that you did not workcontinuously with them during this duration.

so, make the documents and experience for this so strong so that they don't feel the need to make an inquiry
