Can we submit PR application without FBI Fingerprint?

Hello All. I am a Canadian, and my husband is an American. We both currently live in the US. We are completley finished with his applicaiton, including medical, but are just waiting for the FBI Fingerprint. Apparently as soon as we submitted, the FBI had a "IT Update" which is now taking them 3-4 months to get it done vs. 30-45 days :eek:

I am a little frustrated waiting for this, and was wondering if I am able to submit without, and just provide the FBI fingerprint check when I receive it? As well, I was reading in previous posts that people in the US also needed a State background check, but that wasn't in the PR Checklist of documents required... is that still a requirement?

Any help would be VERY greatly appreciated.

yes, since FBI checks are currently taking 12 weeks to process, it's recommended to send in the application without it, noting it has been requested and it will be forward once received. generally, CIC looks the other way and will process the sponsor's application which has no relation to the FBI check. generally, if the record was not provided upfront, it will be requested upon sponsor approval, so hopefully by that point you will have it in your hand to send them. Again, there is not guarantee CIC will continue allowing this. For most, it seems to be the best solution.

not all applicants are required to get state records. it's not necessary to get them unless they are specifically requested by CIC. A majority of applicants never have them requested, and i *assume* the request is based on some issue found on the FBI record. If you know of an issue that will come up on the FBI record, then by all means order the state clearance too and send it all together and provide as much info about the incident and the outcome as you can.

Perfect!! Thanks so much rhcohen2014!!! I think we will definitely go that route, as when I talked the FBI office today, they said they are behind, and the timing is around December for receiving it (even though submitted in August). I was hoping for your answer, as I was thinking the same thing that the Approval to Sponsor is on me, not my husband, so they shouldn't be looking at the FBI request until after that (and I should *hopefully* have it by then). There should not be anything of concern on the FBI background check (worst he's ever done is received a few speeding tickets), so I think I will just submit and see if a State record check is requested.

I really appreciate the help, and this forum is a really great resource for the newbies!

My law office also stated that the FBI clearance is the 1 thing you can submit after the full application is sent. I might just send the receipt that states you got your fingerprints done and will forward the police clearance in as soon as you receive it.
