Can we apply for Visitor Visa after work permit expired ???

Hi everyone, I have some very important questions: 1) Can I apply for visitor visa inside Canada if my work permit has been already expired and I have applied for work permit extension (maintained status) before my work permit expiration. Do we need valid work permit to apply for Visitor Visa inside Canada?

2) If I got my TRV as a visitor with stamped passport after I got my PGWP, then do I need to apply to change my category from worker to visitor after my PGWP expires or it automatically changes?

3) If my wife has also applied for work permit extension before her work permit expiration, and if her work permit extension rejected and then if she doesn't have valid work permit then can she apply for visitor visa inside Canada or should she apply for restoration of status?

1. You cannot apply for TRV from inside Canada until WP extension is approved. On what basis are you eligible for WP extension.
2. If PGWP expires,, you have to maintain status in Canada and change to visitor. It isn’t done for you.
3. If her WP extension is refused, she can still work until work permit expiry. Once her WP expires, she must change status to visitor. She cannot apply for TRV from within Canada.

Let’s say, my work permit got expired on June 23rd 2024 and then I have applied for work permit extension which may got refuse in one week, then can I apply for restoration of visa as a visitor or do I have exhausted my 90days period of restoration? Does the processing period of my work permit extension application counted as restoration days? Or the restoration days will start counting once I get my work permit extension application refused?? Please Help.

It should be based on June 23 so no longer able to restore status. WP refusal may state you are out of status and must leave Canada.

If refused, you are out of status immediately. You may be able to maintain status if in the refusal IRCC states you can restore status.

@Naturgrl So from the link, it should be fine if I restore my status after the refusal of my work permit extension application. And if the officer doesn’t say anything regarding the restoration in the refusal letter, then also I could apply for restoration, right?

If refused, the letter should tell you if you can restore.

Just apply for asylum, no one can remove you from Canada for at least 5-10 years.
