He was living commonlaw with *apple* for one year and 7months. *Apple* was cheating on him so he moved to small town ontario and got married to *Grapefruit* they lived together for 5months
Him and * Apple* got back together this month. He has not told*Apple* that he is married. *Apple* thinks he was just staying with friends
He is applying to restore study permit
1.Can he still put commonlaw with *Apple*?
2. If he does not put separated from *Grapefruit* will IRCC find out he is married?
3. Can him and *Apple* fill out the "statutory Declaration of Common-law union because they did live together before for the one year and 7 months?

1. No. They need to live together for a full year again to establish common law status.
2. Yes. Assume IRCC will find out which will put him at risk for being banned from Canada for five years, as well as having his application refused. If IRCC doesn't figure it out now, they will find out later once he applies for PR and he'll be looking at a refusal for misrepresentation and five year ban from Canada then. It's really a horrible idea to lie in an immigration application. If he wants to have any future in Canada, he needs to be truthful.
3. Again, no. They are no longer common law since he got married. They need to live together for a year again before they can classify themselves as common law.

Time to come clean about the marriage.
