Can the PA request to remove the PR status of the spouse dependent?

Hi everyone,

Can someone help me im the Principal Applicant staying 2 years already my spouse had gone back to our native land last year october 2016.

My question can a dependent pr status be requested to be remove by the PA ? Reasons are the spouse is very abusive verbally and suspect mental disorder which is yet to be proven.

Please help i just want to protect my children. The spouse is already separated from us a month after she arrived in canada. We have planned to file a divorse but due to suspected mental disorder my spouse is on and off cooperating.

Is there any legal grounds in current immigration and family laws to prevent her from coming back?

Her family doesn't want her to come back to canada so she could be treated emotionally and mentally. She is living alone when she was here canada. She wants her common law partner (she had a child from another man) to come to her back in canada. She also rejected treatment and counceling here in canada and in our native land.

Please help i dont wanna be the bad guy here but she is a big problem not only on my family and my kids but also to her family.

No - you cannot request that her PR status be revoked. No - you cannot prevent her from coming back. Legally her PR status is hers to keep. You cannot remove it and you cannot control her travel to Canada.

You should work with the Canadian legal and court system to ensure you have full custody of your children and are able to protect them this way.

I am currently working with an attorney on the divorse. She doesn't care about the custody of the children because they are already 12 and 16. The children would rather stay with me as their choice of decision.

On the divorse part she won't cooperate even signing the papers which is hard to move on. She had a new child from another man confirmed by her sister last month.

My kids are already affected emotionally i don't want to give in to the problems but all i can do is seek advise and help.

There's really nothing you can do from an immigration perspective. Her PR status is legally hers - and you have no rights, influence or control. She is entitled to keep it provided she meets the residency requirement and resides in Canada at least two out of every five years.

I've never been divorced, but I am assuming the usual response to a situation like this would be divorce, sorting out custody matters, and getting a restraining order if need be.

I doubt controlling your spouse's travel freedom is going to help. It seems more punitive to me.

I'm guessing you and your spouse have citizenship from the same country? I don't suppose you want to get he kicked out of that country too, maybe adding the countries you vacation in frequently while you're at it?

If you want her away from you, the correct response would be a restraining order, not trying to take back her PR status. (Which others have made very clear is hers and hers only. Dependant/PA means nothing after landing is completed.)

Dear all, although i had applied as a single applicant in may 2020, and in july 2021, i got married (marriage registered). Informed IRCC about marriage and non-accompanying spouse in feb 2022. We are having a troubled marriage and now, my husband is refusing to cooperate for medical/pcc, and threaten me to divorce him or file a petition first, if i want his support. I do not want to file a mutual divorce, for obvious reasons, as my husband and inlaws are involved in adultery and domestic violence, this way they are looking for a safe passage.

1. Now, if IRCC will ask for spouse medical/pcc, what documents or affidavits can be provided to convince them to proceed without my spouse details?
2. Any samples of affidavits? Please.
3. Please share solutions as i feel stuck.
