Can Students apply under Temporary foreign workers class in CEC after new rules

Hello,

Looks like CEC Class work experience requirements are going to reduced from 24 months to 12 months most likely from January 2013. However, I am still looking to find out answer for whether International students who studied in Canada for 1 year or 2 year and have 1 year of skilled full time work experience and have their work permit expired, would be allowed to apply under Temporary foreign workers stream in CEC Class after changes ?

I guess for Temporary foreign workers they assess English test results as well as 1 year skilled work experience (After new rules), in my case my work permit is expiring in this december 2012 and new changes are expected to come in January 2013, I have already 1 year full time skilled canadian work experience and right now I am on my post graduate work permit ( 1 year post graduate study in Canada) and can submit English test results for academic or general module, would federal government consider my application in CEC Temporary foreign workers class if my work permit expires ?

To apply under the graduate stream of the CEC, students must have graduted from a program of at least 2 years. This requirement does not change even under the new rules.

Right now, students who graduated from a 1 year program, need 2 years of skilled work experience to be eligible under the CEC - foreign worker stream. When the new rules come into effect, such students will only need 1 year of skilled work experience to be eligible under the CEC- foreign worker stream.

The IELTS test should be the general module. The generic application form does ask for current status - in order to select "worker" status, you should apply before the work permit expires, assuming you meet the work experience requirement by this time. You should also ask your employer asap to apply for a LMO(or find an employer willing to) and if approved, you can apply for a closed work permit. This will allow you to continue to stay in Canada legally.

If you can't find an employer, you can consider changing your status to visitor(not allowed to work) or go to your home country and wait for your application to be processed. Note that you should choose a visa office that you easily go to in case there is an interview. Goodluck!

I have worked 8 month in Toronto as well as this is my 4th month in Saskatchewan of Skilled experience, however my work permit is expiring in this december 1st week 2012. In worst case if I can't reniew my work permit OR in between loose my job due to any reason and have to return back home, Would I still be considered in CEC Temporary foreign workers stream under new rules in January 2013 provided I have 1 year skilled work experience and General module IELTS scores ?

You will be eligible under the foreign worker stream.

Sponsor, no. But yes, you would need a letter of reference from your supervisor / employer. If you leave your position, it is also useful to get the Record of Employment. Your employer is supposed to give it to you within 5 days of ending employment, unless they submit it electronically to Service Canada - in which case, you can obtain it online from Service Canada. Be sure to set up your online account well before you leave Canada -

Hi,

I would also like to get some clarification about students and proposed changes in 2013. It matters if we choose the post-graduate stream and need to get a one-year experience on post-graduate work permit (experience received during school is not counted). With the proposed changes I\d like to go under work-experience stream and use my part-time Teaching Asst/Course Instructor (12-15 hours/week) experience as part of my 2 years in grad school.

My question is, it doesn't matter if I received it while only holding student permit and off-campus work permit, there's no limiting requirement about the type of work permit? I suppose this work experience shouldn't be older than 36 months at the time of filing your application.

Hi Senorita and jess,

Thanks for your useful contributions and information to my situation. I am still very confused about work experience requirement gained. CIC says the work experience must be only on post graduate work permit, they will not count any experience gained on off campus or co op work permit.

However in my case, my study visa were expiring on July 30, 2011 and my program was till August 2011 as I was doing my co op from May to August 2011 and hence I applied for 1 month extension in my study, off campus and co op work permit and I got extension in all three till November 30, 2011.

Later on i finished my study program with co op in end of August 2011 and the letter of attendence from my school which was issued to me says i officially graduated in August 2011 from school having meet all requirements of program. so from September 2011 onward i continued with same company as full time permanent employee and worked on off campus work permit for 3 months till i got my post graduate work permit in december 1st week 2011.


So now in my case, would CIC allow me to apply under new changes in january 2013 and would consider my 3 months off campus work permit experience, which i gained after i graduated from school in August 2011 ? OR do i must need to finish 1 year experience on post grauduate work permit ? i have it valid till 6th december 2012.


your advise will be highly appreciated.
