I need help from you guys on that.

I am here in Canada on CLOSED WP(Since May 2010) and applied for the PR under CEC on 17th Oct 2012. I have valid WP till 23rd Oct 2013 and valid visa also by that time. I have received the AOR in 1st week of December. My employer is planning to send me back to India by May End but I want to stay here till i get my PR. I am planning to quit my company in May begining but I cannot apply for BOWP before 23rd June 2013(it has to be four months before the expiry of the WP).

So my questions are:
1) Can I stay in Canada even after quitting my job?
2) Will I be considered illeagle for the period say 15th May(the date I quit my Job) to 23rd June(the day I apply for BOWP)?
3) Do I have to notify CIC immediately of this change?
4) Can I apply for visitor visa before so that I can secure my stay here in Canada till I get my PR.
5) Can I leave the country and come back as I have valid visa(worker) till 23rd oct 2013.

Help is appreciated.

Yes - as long as your work permit and visa are still valid. Note, you can't work for anyone else while holding the closed work permit.

No.

It would be advisable. Yes.

4) Can I apply for visitor visa before so that I can secure my stay here in Canada till I get my PR.
If you change from work permit to visitors visa, you wont be able to apply for BOWP.

5) Can I leave the country and come back as I have valid visa(worker) till 23rd oct 2013.
Technically yes, but if they quiz you thoroughly and you have to explain you have a valid work permit / visa but quite the job, you may need to prove you have funds available for the duration of your stay.

So will my employer inform the CIC regarding my quitting and/or may cancel my closed WP as it is tied to Company. Can they do that?
Considering this can i come back again to Canada(planning to go in June start) as the Visa says Worker VISA.

Nope... The WP will be valid till the expiry date, even if you aren't working for them.

Seniors, In continuation I have a question, Can mishki apply for an Open Work Permit (not BOWP). Even one of my friend is in the same situation with an exception that his WP is valid for another 1 year and cannot apply for BOWP.

Can he search for another job and change his employer? Initially he is on Intra Company Transfer and doesn't have a LMO.

If he can find a job that is LMO exempt, or find an employer who will apply for a LMO, then yes.

Hi Members,
Need urgent help.
I am on closed WP (ICT), from the above thread I understand that I can quit job even on ICT VISA and stay in Canada too. My question is how much notice period do i need to serve to the employer? I came to Canada in July -2017, so it has been less than an year but I am employed with the company since Feb 2013 (offshore).

Yes - you can remain in Canada (although obviously not work).

I would recommend giving your employer 2-3 weeks notice. This is pretty standard here.

Thanks for you quick response. Can you please help with below queries:
1. Can i quit with 2 weeks notice, do i need to negotiate this with HR or it is as per government rules/policy.
2. My notice period at offshore was 3 months - does this impact my notice in Canada in any way?

I came to Canada in July -2017, so it has been less than an year but I am employed with the company since Feb 2013 (offshore).

You can quit and remain in Canada until your permit expires. However, you cannot work for another employer unless & until you obtain a new work permit.

If you have any hopes of applying for permanent residence with Canadian work experience, I would strongly recommend sticking it out for at least one full year - minimum of 52 weeks (through July 2018).

As for notice period, that should be in any kind of contract or letter of appointment. It would be a minimum of 2 weeks, but check your contract. If you want to stay on good terms with your former employer, you would need to figure out the norm for your position and company. The more senior positions usually expect more time.
