Can my husanband sponsor me for Canadian PR while living in US

Hi all,

Is it posisble for my husband (a Canadian citizen) to sponsor me for Canadian PR while he is living with me in US.
I, myself work here in US.
We have decided that it was the best option for him joining me here in the states as we are focusing more on my career.
But while he is here unemployed (planning to study a program at a university here), can he sponsor me? Or does he have to be present in Canada when he submits an application to sponsor me.
We are thinking to move back to Canada in the future. So thought best for me to have the Canadian PR. I was prinously a Canadian PR. But could not maintain it as I had to move out for this job in USA.

When he applies to sponsor you - a spouse, he may live in USA or any other country; HOWEVER, for you to get PR in Canada he MUST convince CIC that you and him are planning to go to LIVE in Canada as soon as you get PR visa.

If you plan to live in USA, there is no reason for you to get PR status in Canada now.

Good to know that we need to convince CIC we will move back to Canada as soon as I obtain the PR.

Would it be an issue with him being unemployed in USA when he puts in application? I am the one who has income here and taking care of him financially.

Agreed. IRCC seem to be becoming much more strict on the PROOF of intention to return to Canada IMMEDIATELY after PR is granted. Some visa offices are actually demanding formal, accepted, resignations from the sponsor's employment in order to approve the PR application. We have seen quite a few of these recently on the forum.

If your potential sponsor can't meet this level of proof of intent, it's quite possible that IRCC will refuse the application.

From your previous posts, you became a PR in 2014 and left Canada in late 2015 or early 2016. This means you are still a PR and you still meet the Residency Obligation, so why would you think you need to go through the sponsorship process?

Not meeting the residency requirement of 2 years.

I looked up and what I found was that if the applicants leave to accompany their Canadian spouses who are employed outside the Canada, then the time counts towards the residency requirements.
My husband is not employed here in the States. I am the one who left Canada to work. He joined me afterwards. So in this situation, this cointing is still valid?

Oh you are right. I looked up again. If the spouse is Canadian, then it doesnt matter if the spouse is employed or not. It coounts all the time spent outside Canada towards the PR obligation. However, the time spent living outside Canada with a spouse who is also PR wont count unless the spouse is employed in "Canadian business” or in the public service of Canada or of a province.
