She can not be conjugal if she is able to live with you and without knowing your circumstances it is very unlikely that as an American you qualify under the conjugal partner rule.
That is very good but have you checked into what CIC means by conjugal? The main criteria being that you are unable to live together. It is actually quite rare to qualify as conjugal.
Unfortunately, you are not well-informed about the application categories. Because you can be physically present together, you face no bar to either marrying, or living together common-law, and therefore do not qualify under the conjugal category.
