I submitted my inland app back in nov of 2012. due to delays we still don't have AIP or an OWP (sent with app).

my question is if i can do freelance writing for a local newspaper?

My understanding is that, no, you cannot receive payment for any service rendered in Canada until you have a status that permits you to work. You can volunteer, but there are even some strings attached to that (you're not supposed to do anything in a volunteer capacity that otherwise a Canadian would be paid to do...not sure how that is determined/proved, though).

*fingers crossed* that you hear something SOON! They've finally been moving some on fall 2012 apps.

Sounion - Why don't you try asking CIC and just see what they say? Maybe you will luck out and get a helpful agent..lol. The other option I believe would be to call to get the Labour Market Opinion thing. I had info on that before, but I'm at work right now. I will try to look up the number for you later. They could give more for sure/accurate advice. Don't want to turn the opportunity down if it turns out you can. But don't want to do it and risk anything with your Application! :)

It doesn't matter if employer don't ask for work permit. Sounion doesn't even have a SIN anyway so sounion cannot legally work or get paid at all. You can't get SIN without a work permit.

On another subject, why are you popping up on threads giving advice that is illegal or can jeopardized other people's application. Are you trying to get others cancelled so you can speed up yours? What's your logic here?

the job would be freelance, so they just pay you cash or check, without the need for a SIN. In reality, I imagine I could do it and it wouldn't be an issue. BUT if CIC found out, it wouldn't be good.

If you process you application then you cant work for 10 MONTHS!

You have to be realistic here...

What does the CIC expect, how do you get by and Survive while in Canada?

If you can get away with it then do it as long as its Cash or Cheque and then there's no way the CIC can track it and find out.

At the end of the day everyone is happy.

CIC expect you to be supported by your sponsor until AIP stage. Which is suppose to be 6 months which lines up with 6 months visitor visa max stay. Unfortunately it has extended up to 11 months. That still does not justify taking matters in your own hands.

By the way, cash is the only way that is really untraceable. By cashing in a cheque, the money is still traceable. Can cause a sh*t load of trouble for you when the other starts claiming it on their income tax form for deductions, which traces back to you. This is why getting paid cash in considered the prefer method if one wishes to avoid getting caught. Although it is hard to find someone willing to pay cash. Everyone knows that when one requests cash as payment, they know something is on the up and up and tends to walk away.

Seriously! You're telling the OP to RISK everything for what a couple of hundred bucks - "if you can get away with it" and what if you don't get away with it, what if someone reports it! What if the newspaper publishes OP's name on the article and someone reports this to CIC.
Why would you risk it?
You say people have to survive for 10 months with no income until OWP is approved - but surely OP (1) knew this when he/she applied and (2) this is family sponsorship forum so logically OP should be being supported by the sponsor.

Just to note, I was sponsored by my spouse and we knew how long it took for OWP, and what our $ commitments were, so we decided that I would return to my home country and apply outland so that I could still work (and send $ to canada to pay our mortgage).

Everyone (me, OP and all potential applicants) should know what they are getting into when they choose to make an application - and decide on the best type of application for them and their circumstances.




(seriously, did i just feed a troll here? I can't believe anyone would seriously give this advice)

Quite a few others have "down-rated" this member's advice. He consistently offers very bad advice with a knowing air that might confuse newcomers to the forum as to the value (or lack thereof!) of his input. Additionally, he has some lovely ideas about how his visa-exempt partner's application should be processed more quickly than the applications of those from poorer countries. Pull up his posts. They speak for themselves.

In order to receive payment from a Canadian company while being a freelancer residing in Canada, you would be known as a sole-proprietorship to Canada Revenue Agency. As such you would be required to report all income received from Canadian companies to the CRA, and to not do so would be illegal/tax fraud. And of course in order to report income, you need a valid SIN card which is only obtained with a work permit.

You would not need a SIN and not need work permit, if you were doing freelance work for a company located outside of Canada and being paid from outside of Canada.

If you receive payments from the Canadian newspaper, by either cash or cheque, then one of the following could happen:
- the newspaper will need to report your payment as an expense, so would need to disclose to CRA who they made the payment to. So most likely ask at some point for your SIN and all personal contact details which would be reported to CRA
- if the newspaper pays you with cash under-the-table and doesn't report it, then the newspaper is committing fraud. I doubt a legitimate newspaper would do this
- if they pay you in cheque, then when you cash the cheque it will be easy to see that a company is paying you money for something
- if any work you do has your name on it, or people know you did it and it's published... then anyone (competing freelance writer?) who knows your status in Canada could report you to the CRA for tax fraud

In your situation since you applied back in Nov 2012... you should be getting stage 1 approval/OWP any day now based on 11 months processing time. Don't risk it when your OWP should just be a short time away.
