Can I sponsor my husband while he is in Australia as a refugee claimant ?

Hi. Can I sponsor my husband to Canada ? He is a refugee claimant in Australia his refugee status was denied and is in the appeal process there. Can I sponsor him meanwhile ? I am a Canadian citizen living with him in Australia right now

Yes, but you have to reveal that information to CIC in the forms. You might end up with extra scrutiny due to the failed refugee claim. They will want to make sure the marriage is genuine and not just for a ticket to Canada, though I don't think this is as detrimental to the process as a Canadian refugee claim.

You will also have to show you both intend to relocate to Canada. A refugee claim in Aus makes it sound like you wanted to settle there, and sponsors who are living overseas have to show they intend to return to Canada.

Whatever you do, don't lie about anything, as they will find out and ban your husband for 5 years.

Thank you. No it's only him that filed for refugee claim in Aussie. I'm here on a working holiday visa so I can be with him and support him financially as he lost his work rights ...

Yes, my answer was meant for his situation (I should have wrote "him" instead of "you", I didn't think a Canadian citizen would need to file for a refugee claim in Australia. :) )

But, I don't know your circumstances, so I can only go by what you've said. If I were a CIC officer, I would think why would he bother filing a refugee claim in Australia when he could simply be sponsored by his wife? See what I mean...

The claim itself doesn't prevent him from a PR sponsorship, it's just the circumstances around it that need to be addressed in your application.


EDIT: I see you have another post where you reveal your husband has no passport. Without a passport, he can't apply for PR.
