Can i sponsor him?

Facts about us:
-Been together since 2011
-His visa expired so he had to go back 2011 as well -> told him i was pregnant so he decided to try and come back to Canada
-Haven't lived with each other because he couldn't come back for 2012 (forgot to hand in paperwork with visa application)
- So we went to his country for Christmas so he can meet our son & so we could be together for a little while.
-Have a 8 month old son (both of us are on Birth Certificate)
-Planning to come back for spring 2013 for landscape construction again.
-We are going to get our own place when he's here

-Currently a full time student graduating this spring
-Job: Landscape construction (seasonal - start in spring)
-21 years old.

So basically can i sponsor him as a common law or something?

Hmmm pretty tricky to guess, so I'll just ask : did you both ever live together for 1 continuous year? Any proofs of joint stuff that you can show the CIC? such as, joint bills, joint bank account(s), etc...

If you haven't lived together for 12 months without interruption, then you don't qualify as common-law. From the dates that you have written above, it doesn't seem that you have lived together.
So - if you want to sponsor him, you can either first live together 12 months, the apply, or get married, and apply just after that. If you're married, you don't have to live together for 12 months.
Whether married or common-law you will still have to prove that you are a genuine couple, but if you stayed together first in Canada, then in his country, have a son together, and proofs that you are a couple (financially dependent on each other etc), then you can put your application together and have a good case - but you need to qualify as common-law or get married first.

i will not take any chance to send any type of application now, your case seems not strong enough to show any tie with the one you love. from my point of view, i think you should get married first, wait for some time do not rushed, and then aplly for sponsorship, as you have a kid, the process will be more genuine and you have to proove genuine tie with canada, such as friends and families and so on, thats very important.
