Can I live with my husband after applying for a sponsorship from Canada?

Here's my story:

I am a Canadian citizen. I was born in the U.S. and also have a Pakistan passport .
My husband was born in Pakistan, and has lived there his whole life.

Our families have known each other before we were born (my parents lived in Pakistan before moving to U.S.A.)

Summer of 2009- my family went to visit Pakistan, and my now husband and I took a romantic interest in each other. ;) Once we left Pakistan, we communicated online, and on the phone.

January 2010- We got engaged in Pakistan :D

December 2011- We got married in Pakistan ;D

January 2012- I came back to Canada with my family

May 2012 - The CPC-M received my application for sponsoring my husband.

Well, as you know, the sponsorship application has two parts.

The normal processing time of the first part usually takes 66-86 days, and for me this time has long passed, and yet they are still processing it when I called last week.

The second part takes 26 months normally, and I thought that I can wait it through. But now, in Canada, and away from my husband, I am starting to miss him a lot. :'( And seeing that the first part is taking so long, the second part may take longer. :-[

And I know each case is different, and you can't ask them to speed it up, but I was wondering if I can go back and live with my husband until the application has been fully processed.

I know that as a citizen, I can apply from outside Canada, but at that time, I thought I was able to wait, so I applied from Canada. Am I allowed to go and live with him for about 2 years, while the application is in process? Or do I have to stay in Canada? Or do I have to wait until at least the first part has been processed?

And if I do go live with him, would I have to tell the office (my family will be living at the mailing address that they have, so I will still receive any letters)? Would informing them delay the application even more?

Also, would I have to prove that I will return to Canada? If yes, what proofs are there, and how do I send it?

you are a Canadian citizen, so yes you can go and stay with him, but you will have to then prove and provide evidence of you shifting back here and resume your ties to Canada once ur husband gets his PR, thats all...

you will need to tell them of where u will be staying so any correspondence can be sent to you...

you will have to show something like returning to work, school, etc... or something like "me and my husband will be moving into 45 Skyway Ave once he arrives, we will be paying $500/month to XYZ" this can be your family too... or any other volunteer thingy or anything that shows your ties to Canada

From the timing you shared, it sounds like you applied Outland. If so, you sent your application to CPC-M in Mississauga and they will forward your application to Islamabad. Note that 'Outland' vs. 'Inland' is determined based on the application you use (and therefore where you mail it it) and not based on where you are when you mailed it. Since your husband wasn't in Canada you couldn't have used the inland route anyway.

Given that, it may help you to have some additional facts on timing for step 2: in 2011, Islamabad completed 20% of cases within 16 months, 30% in 17 mo., 50% in 19 mo., 70% in 23 mo., and 80% in 26 mo. So, it is unlikely that it will take your case longer than 26 months.

You mention possibly moving to Pakistan during your application. As a citizen you can do that. However, you will have to prove you intend to move back to Canada once his application has been approved. How you do that depends on the specifics of your case (e.g., job, housing situation) but it will be very important. Search for posts by stevelo for an example of someone who moved away after applying (he got a job in the US and ended up getting lots of questions about whether he really was going to move back delaying his process). You should let the visa office know of your change in circumstances (part of what you signed committed to letting them know of any change in your personal circumstances).

Have you considered visiting him several times during the process but still living in Canada (job permitting)? The separations would be very hard but that way you would avoid complicating your application and could make his settlement easier. If he has a US or Canadian tourist visa, that would open up your options too (if not, you could apply but it would be hard since they would question his intent to leave for obvious reasons)

Is there really a law or it's just a speculation that it slows down the processing??
Am asking this because my wife(PR) is coming to India next week for about 3 months because my Mom had a surgery last month and now she wants my wife to be with her all the time till she recovers completely(Till Jan'13)..
When I read this post I got confused.. Please tell me, she has to come and it's not possible to cancel the trip, any suggestions or mails need to be send to NDVO for intimating this??

I would call CIC again and again until you have more information. It is way too long if you have not received your first stage approval. I am also a May applicant. Look at the spreadsheet for your reference. And join our May 2012 thread if you want :)!

The rule is that a Canadian citizen can stay outside of Canada and still sponsor a spouse or partner. A PR has to stay in Canada to sponsor someone. Your wife is a PR and is sponsoring you? In that case, she is supposed to stay in Canada throughout the processing time. If she stays away too long the visa officer can refuse the visa.
The problem is the rule does not state how long 'too long' is. This is up to the visa officer. A two-week vacation is fine; 6 months away probably won't be. In your case I would say your wife will probably be OK if she just stays away for 3 months. Don't tell the visa office, and make sure there is someone at her address in Canada to get any mail from the CIC. She should also keep proof of why she had to be away, in case the visa officer finds out.

You can go live with him. It should not delay the process, as long as you have good evidence that you will return to Canada to live once your husband gets his PR visa. Because you have Pakistani citizenship as well, the visa officer will most likely be suspicious about this.

I would tell them. Living together is good proof your relationship is genuine, so while you are there you should also continue to gather evidence about your relationship. You can keep your mailing address as the one in Canada if the mail system in Pakistan is unreliable.

If you tell them - and I suggest you do, since they will ask how you keep in touch at the interview - you will also have to have proof of your intent to return. You can show what you will do to leave Pakistan, and also what you will do to resettle in Canada. So get a letter from your parents stating that they will allow the two of you to live rent-free in their house until you both get jobs (or whatever the case is), show evidence of a job search or applications to schools. Show proof you have arranged the return of your belongings to Canada. A lot of this is something you won't have evidence of right away, but you don't have to send it in right away because the application is already at Mississauga.
