Can I include my wife who is still formally PR of Canada as a part of application for QSC?

Hi All,

My situation is very complex and therefore I need specific answer, rather than reference to Q&A which does not answer my situation. Me, my wife and my elder son were Permanent Residents of Canada, but we did not meet residency requirements due to personal family reasons and therefore were not able to renew our PR card. Thus I decided to formally renounce my Canadian PR status so that I can apply again. However, my wife and elder son have not renounced their status, even thought they did not meet the residency requirements either. Now I want to apply for Quebec Skilled Worker Immigration program and wondered if I can include my wife and elder son into my application? They are formally still Permanent Residents until court decides otherwise. So my question is, if half of my family is Permanent Resident of Canada (federal program), can I still include them to my Quebec Selection Certificate application or not? Or even more short, can already Canadian Permanent Residents (federal program) apply for Quebec Selection Certificate?

Not complex at all. They are still PRs and cannot be included in your app. They need to renounce PR status in order to be included in your app.

If she wants to retain her status, she needs to enter Canada at a land border without being reported and remain in Canada for 2 straight years to once again meet the RO. With an expired PR card, she will likely be reported.

Or she just renounces her status and become a PR with you.

I guess Canada recognizes American Radiology Association Certified Sonographers, so she should be fine I guess.
Didn’t realize she was American. You still have the issue that your wife and eldest son are not compliant with their RO. Quebec has been changing their immigration programs do you and your wife speak French? If you delayed moving to Canada to get US citizenship what is the purpose of moving to Canada?

Yes, we all got american citizenship, the reason we want to move to Canada is gun laws and health care. We are very afraid of mass shootings and new series of laws permit concealed gun carry in public universities. We cannot not afford private ones, and afraid to send our kids to public ones because of the guns. And medical is whole another story, it is terrible here, 50% of bankruptcies are medical bills related.

While I am here, I wanted to ask a question re Federal Express Entry program. If I apply alone for Express Entry program, because as you already know, my wife and elder son are ineligible due to presumed PR status, can I still show my younger son as an accompanying child? Thanks in advance!

We are very afraid of mass shootings and new series of laws permit concealed gun carry in public universities. We cannot not afford private ones, and afraid to send our kids to public ones because of the guns. We’re not stupid you are likely trying to secure both citizenships.

So I do not want to use Canadian system, but be a loyal citizen and law obedient citizen of Canada, by the way bilingual too, unlike many Canadians. So my question is can I show my child as accompanying child if I apply alone? The rest I meet the requirements!

You can’t apply alone without someone looking at your wife and son’s case and risking their PR. If you all qualify you should start from scratch. If you are bilingual I would start doing your language testing.
