hello everyone,
I've been tried to search the forum but couldn't find the answer to my question,
I'm currently stay in Canada while I m waiting for my PR, I applied for outland PR and the case already went to my local visa office
however, I would like to go back home and visit my family for x'mas, but I also don't want to risk that I could be deny entry when I try to come back to Canada.
can I apply for a temporary resident visa while I'm waiting for my permanent resident?
will apply a temporary resident visa give me a 100% guarantee that I can come back in Canada without effect my application?
please advise anything that will help me with the headache! :'(

Thanks very much and wish everybody will have a speedy process!

What country do you hold passport from?

If you are from a visa exempt country, then you shouldn't have anything to worry about. You applied outland according to your heading. So it shouldn't affect your application process. If you applied for PR within Canada. That is a different story.

You cannot renew your TRV while you are in Canada awaiting PR. That can only be done outside Canada. You can keep extending your stay in Canada while waiting even with an expired TRV. However if your TRV has expired, you have to reapply for a new TRV outside Canada, in your home country, the moment you leave Canada. CIC will know you applied for PR to Canada and will not likely grant you a new TRV. You would have to stay in your home country until PR is completed.

thanks very much for both of your reply,
I'm currently a Taiwanese passport holder of the ordinary passport issued by the Ministry of Foreign Affairs in Taiwan that includes the personal identification number,
I used working visa to enter Canada, however, my working visa is expired after I sent my PR application. I do receive my UCI and file number for my application,
I just want to know if there will be a problem for me to leave and re-enter Canada?

So what status do you have now? if you didn't apply for a visitor visa after your work visa expired, then you are currently in Canada illegally. If this is true then there's a good chance you would be refused entry trying to re-enter, since you have already overstayed.

Remember there is no implied status with an outland application so you need to maintain status on your own. Even if you are from a visa-exempt country like Taiwan.

Just apply online for a visitor visa extention stating that you are awaiting PR approval. Most likely it will be granted. You can apply while still in Canada.

But if they are not here on any current status (i.e. work visa expired and now here illegally), then what can they apply to "extend"?

Can you apply for a transition from work to visitor visa, after the work visa is already expired? I'm not sure of this.

Anything you do that involves leaving Canada, likely means you're not getting back into Canada very easily. Time your vacation with your anticipated receipt of COPR (if you feel you have a strong case). A visit home say next Feb/Mar in that case might be better than one in December and not coming back right away. (Depending on your situation of course.)

I'm getting more and more confused and worried about my status in Canada now,
I thought the implied status will apply to my case but if its not, what will happen if I keep staying inside Canada?
I will look into extend of the visitor visa as well, at the mean time if you have any advises or helpful tips,
please let me know
thanks again for all the kindly replies.

There is no Implied Status from applying outland, so if your work permit expired, you are currently illegal.

If it expired less than 90 days ago, you can apply for Restoration of status, along with a change of status from worker to visitor.

If it expired more than 90 days ago, the only way to legalize your status is to leave Canada.
