Can I extend TWP with dual intent while processing PR application?

I've been looking through this forum and haven't really found much, so I decided to start my own thread.

So here's basically my situation. My boyfriend and I have been together for about a year now and just recently I got approved for a TWP that will last until July 2012. So I'm moving to Canada with him and after we've lived together for a year we plan to apply for my PR under common law marriage. Now I'm wondering if it's possible for me to apply for an extension of my TWP with dual intent, while we wait for the PR application to go through or not. I'm not sure if the extension will look suspicious since I didn't mention my boyfriend as the reason I mainly wanted my TWP in the first place.

So basically I'm wondering if anyone has been able to successfully apply for a TWP extension with dual intent in order to stay in the country until their spousal application is done?

I am assuming you are a US citizen.

You can do this two ways:

1)Wait one year, and then submit your PR application INLAND. Include with this application an extension of status request. Emphasize that you want extension app processed AFTER acceptance in principle on PR.

2)Wait one year. Assuming you get there March 1st, wait until March 1st 2012. Submit outland PR application to Buffalo on March 2nd. Wait until July 1st. Submit extension of status application ONLINE. Since Buffalo is fast, you will likely have your PR before your extension of status document is processed.

1) is safer if your goal is to stay in Canada, but no appeals. 2) is shorted since outland application process more quickly and the result can be appealed.


.... or don't wait one year, and get married! Then you can submit outland application long before you work permit expires.

.... of course, you do realize the world is coming to end December 21, 2012, so maybe there isn't much point going through the immigration process.

Thanks for the feedback. :)

I'll be moving there on March 7th with him, but we'll be living with his parents at their house for about a month to 2 months in the beginning more than likely. Still planning to get a joint bank account and all that early though. I think I'll go with option 2 as we really want me to be able to work while I'm up there with him and if I'm not mistaken I think I read that with an inland application the applicant can't work. I may be wrong, but I think that's what I've read. I hope it'll go through quickly as well, lol. We're taking a cruise together this summer and there's a chance we will be getting engaged early next year, so maybe we will be married before we start the process. Who knows.
