Can I be deported from Canada being a PR by working under the table for 2 months

Hi

I need help with my case please.

I worked legally for a family for about 10 months, then they let me go because they didn't require the same amount of hours from me and I needed a full time job, also my job description changed out of the blue and they also changed my schedule. However they couldn't find anybody to replace me at that time and they offered me to stay a little longer and they would pay in cash, I accepted since my husband was unemployed at that time. So I worked for 2 more months being paid in cash and they used me to help them move house, carry boxes, cleaning, anything they wanted, bottom line - they used me. We exchanged some nasty emails because I got really hurt about the whole situation and they said they wouldn't give me a reference letter even after everything I've done for them.
Now I stopped emailing them and they stopped too, but I got scared that if they want to go after me (since in my opinion they are evil people), would they be able to report me for these 2 months and I'd lose my permanent residency? What would be the consequences for them if they did such thing? I am a permanent resident and married to a Canadian and never had problem before, my ex boss also did not threaten me but my husband thinks I might be in danger in case he goes after me which I think he would be dumb to do since it was his idea to pay me in cash and he probably would have to pay a fine. I decided to ask help here because talking to other people they said I'd go to jail and here people seem to be more knowledgeable about the subject. Thank you

No - you can't be deported from Canada for working illegally as a PR.

However Revenue Canada could come after you for failing to pay taxes on income you have earned since tax evasion is a crime.

1. In the unlikely event you were charged with tax evasion and this could result in a maximum custodial sentence of 6 or more months then you become inadmissible and would be removed with PR revoked. If it ever went to court then this is a he said she said scenario and CRA have much bigger fish to fry...however way you look at it cash in hand is just part of the every day economy.

2. Cash in hand downside is mostly an issue if you get injured/unemployed and are ineligible for any WCB or EI related benefits. There is a matter of fraud too if you are getting benefits based on a nil or lower income than that which is actually your higher true income.

3. Down the line when you apply for citizenship unemployment is pretty much the number 1 flag for being RQd.

What if I file the hours I worked under the table next year with the Tax report of 2014 and pay whatever I have to, I was thinking of doing that, calculating all the money I made in these 2 months in cash and pay and file it in 2014, would I be legal then? Is this something I could do even though my ex boss wasn't paying tax in my name?

If the cash was earned in 2014, then what you say is the right thing to do.

If it was made earlier (say in 2013), then you need to change your 2013 return (can be done online at CRA's website) declaring your additional income. Then you would be abiding by the law and will be able to sleep well.

It was April and May 2014, so actually I didn't work illegally, if I had refused to claim the tax, yes, but because this would be in 2015 only and I will file it then, I'm not really illegal in my understanding.

I will have worked illegal if coming the tax return in 2015 I decide not to file these 2 months of work, is that right? My husband said that I can file in the form where it says other moneys earned and put the total amount of the 2 months I worked, therefore if one day my horrible ex boss decides to come after me for some reason I would have proof that I paid my taxes and actually he was the illegal one because he didn't claim from his part. Does that make sense??

If that makes sense I feel better already!

Yes, simply report all your income when you file your 2014 tax return and you will have nothing to fear.
