Can I apply under FSW-Inland after 2 or 3 months in Canada

Hello all,

I am anticipating a postdoc, and given the uncertainties regarding the pandemic, I want to get me and my family into Canada as soon as possible, even though I already have all the requirements to open an express entry profile. My plan is to apply after 2 or 3 months when I land in Canada, and so, be processed under FSW-Inland. So, my questions are

1) Is there a time frame that one must be in Canada for to make such an application?
2) If no, then won't I need to submit a PCC for Canada, which might prove difficult given that IRCC only asks for PCC for places where one has stayed for 6 months and longer?

PS: I don't want to wait for one year to apply under CEC, so, I am aware I would need to provide POF.

You can apply now or when you land if you are eligible. You will get ITA if your CRS score is high enough. PCC depends on if and when you get ITA. Is your family coming with you during your post-doc? Is your wife being noted as accompanying or non accompanying? If accompanying she must have ECAs and language tests.

Yes, my wife is coming with me and she will listed as accompanying. Yes, she already has ECA and IELTS. We both have ECA and IELTS, and our IELTS scores are high enough. They got us a CRS score of 493 (using the tool on the CIC website). As you can see, we can readily enter the pool with this score and get an ITA given recent cut-offs, which has been hovering around 470. But there is rumor that IRCC might return to what they did early last year (from March to September) when they were only processing CECs and PNPs. Should that be the case, I don't want to be stuck here. Hence, my plan of getting in with a work permit, and entering the pool from inside Canada.

So, is there any additional requirement to enter the pool inside Canada? I heard a Driver's license is needed or Health insurance card?

I haven't applied as the postdoc hasn't been official, but I am planning on a work permit. My wife would then apply for an open work permit. No kids yet. I guess we will both need TRVs, since all permits are given at the border. Unsure about this, though.

But to answer your question:

You would both apply for work visas. You for an employer specific and she for the OWP. You don't require TRVs - but you do need to wait for the work visas to be approved before traveling to Canada. The actual work permit will be issued when you arrive.

Processing times are quite long right now in many places so make sure you factor that into your plans.

Thanks, but I heard there is now a two week processing period for work permit, under the Global Skill Strategy (GSS): https://www.canada.ca/en/immigration-refugees-citizenship/services/work-canada/hire-temporary-foreign/global-skills-strategy/2-week-processing.html

Or is this just theoretical and nothing ever gets done within that timeframe? That was what I was banking on. I would have to contact LVO then to inquire once the postdoc is made official.

You're talking pre-COVID-19, and even then, the 2 weeks wasn't always achieved.

We are still seeing the rare person here get through quickly. But best to plan this will take months vs. weeks. Definitely do not bank on 2 weeks.

I'm in South Africa. The typical period per CIC website says 19 weeks. But I was thinking this was aside the GSS two-weeks thingy. So, I should take the 19 weeks seriously then?

You should assume 19 weeks is possible with the understanding that it's feasible it could even take longer. Again, always some chance you'll get through super fast but we have plenty of people on this forum who are GTS and have been waiting for months.

I guess I should just wait then and see what happens in the coming draw. If it is an all-program one, then my best bet is EE, since a work permit might take the same time. What do you think?

It's entirely your call.

Express Entry processing time is taking longer right now as well. Lots of people here waiting significantly longer than six months. You certainly aren't going to be approved through Express Entry in 19 weeks. Work permit will still be faster overall.
