Can I apply for Super Visa for my parent if I am on EI?

Hi everyone,

I have few questions regarding Super Visa - I am a PR of Canada and my husband is a citizen of Canada. I was on EI last year and might go on EI again this year as part of a self-employed program they offer. I can take that opportunity or I can get a job. However, I want to make sure that I do not weaken a super visa case that I am looking to submit for my mom. I have the following questions and appreciate if someone can please clarify:

1- For super visa for my mom, does immigration consider my and my husbands income? or do they want me alone to be making equivalant of 3 people per LICO to meet the economical criteria?

2- Do I have to mention in the application anywhere that I was on EI or they don't care and an income from EI is same as income from any other job? does EI income weaken my case?

3- If I get a job now, does that weaken my case as I have a new job and no history in the new job?

4- How many years of Tax results does immigration need for super visa?

Hi there, I'll try and answer to the best of my knowledge. Most of this information is all readily available on the CIC website as well, if you're looking for more of an explanation.

1. You're right that when applying as a sponsor for parents you need to meet certain financial requirements. You'd have to look at the instruction guide to find out what the calculated amount for your family would be. But you can also have a cosigner for the sponsorship. In which case, that person's income is also considered - yours and his would be totalled together. So you could apply as your mother's sponsor with your husband as your co-signer. You'd both need to provide proof of your marriage, of your employment, relationship to your mother and your husband would have to sign the sponsorship undertaking form with you etc.,

2. From what I understand the only thing that would cause you to be ineligible is if you're receiving social assistance like welfare or are in bankruptcy. EI doesn't weaken your chances of a being a sponsor, having your husband as a co-signer would help that as well, if you're feeling uneasy about it. On the financial evaluation form they do ask how you support yourself, I think you would check off "self-employed" as you've indicated in your post and later down the form they ask how much EI you've received. Your co-signer would have to provide the same information.

3. They just want to know that you're employed/receiving an income that isn't social assistance. How long you have had a job isn't going to knock any points off of you, but I also don't thinks it's necessary to go out and get a job if you have other plans for you life. Provide your work history and just be honest. It doesn't sound like you'd have anything to worry about to me.

4. They want an Option C printout for each of the 3 most recent taxation years if your sponsoring. So if you apply after April this year, you would need 2013, 2012 and 2011 printouts/NOA from CRA. If you apply before April you'd need to include 2012, 2011, 2010.

IN short, yes your husband can co-sponsor as long as both income ( including your EI ) meet LICO and includes the following ( as per CIC )

a letter of invitation from your child or grandchild that includes

proof that you have private medical insurance from a Canadian insurance company valid for at least one year and that it
covers health care, hospital costs and your return to your home country,
covers you for at least $100,000 and
is valid for each entry into Canada.

Just to confirm - they only need 2013 income info? and I don't have to worry about 2012 or 2011 at all?

They simply ask latest NOA or Option C, so you need to wait till you get 2013 and then apply

so,if im inviting my mother(me being a pr) and my wife(canadian citizen) is co-signing and she has a son in canada we include him in the family size too?(hes 11 and lives with us in canada)

Yes - you must include your wife's son. So you need to show LICO for 4 people.

Hi there, I hope you guys could respond to my question here. I am trying to get my parents for the supervisa. However, on the low income cut- off side, I only have around 35k. I am bound to have at least 50k to have my parents be sponsored for supervisa. My wife on the other hand is taking care on my 8 months old baby. I just wonder if I we could use that EI she got from maternity??? please help me.

Yes, this is what I did. We are now waiting for PPR for my MIL. I submitted my latest Option C together with my husband's Option C. I went on EI since July 2013 and ended October 2014 and until now not gone to work because I'm still taking care of my one year old son. My husband doesn't earn much so I have to include mine to meet the LICO. Hope this helps.

You can apply immediately if you meet the income requirements.

Hi! Are you referring to a super visa application? Cause I have read in another forum that it doesn't count as income and cannot be included to meet LICO.

Hi

I landed 2 years ago (short landing only) and now planning to immigrate. I would like to call my mother on a super visa right away. But I won’t have a job soon as I land. Can the minimum income be substituted by showing a bank account with sufficient funds (how much) fo her to be sent a super visa? The ties to be returning back home by her can be established easily.
