CAN I APPLY FOR SPONSORSHIP OR PR??!!

my wife is here in canada on visiting visa, we have 2 kids, both with canadian passports, can i apply for sponsorship or PR status while she is living here with me, and would she need to go back to home country to get her visa, or can they change her visa here?

What is your status in Canada? Are you a Citizen or PR?

You can apply to sponsor her while she is here. If you apply inland, then she would not have to go back to her country. You could also apply outland, with her staying here as a visitor. Then she might have to go back if there is an interview.

If i apply inland for her, because shes on a visit visa, which means she cant stay here more than 6 months without an extension, while the sponsorship is being processed, is she allowed to leave and come back? because when i looked up processing times for inland, it said 26 months.

If you are applying inland, apply for the Open Work Permit as well. It's $255 but it gives her implied status from the date CIC's mailroom receives the application, and will typically allow the applicant to stay for 2 years (or to the end of the passport's life minus 1 month). This means your partner can remain in Canada.

Leaves under 1 month are tolerated, but the intention is to stay in Canada..

of course, the intention is to stay in Canada, but I meant is there a need for her to be here that whole time? do they require she be in Canada for the 26 months until she receives a verdict for the sponsorship?

and can i apply for an open work permit without the pr/sponsorship application?

No the OWP is tied to the inland sponsorship application. Processing times have dramatically decreased lately. If the current trend continues, cases from March will have PR before Christmas. The average over the last year is currently 22 months. Yes the expectation is she remains in Canada. Short exits are tolerated. But you run the risk of CBSA denying re-entry. If that happens, that could lead to her PR application being deemed abandoned and therefore cancelled.

Sponsorship is an application to sponsor a person to get a PR. 26 months is out of date. Here is the latest statistics: http://open.canada.ca/data/en/dataset/53105221-7652-47b1-96e2-1f85715a067c

The processing times have been long yes. But under the current ministerial direction, they have made great advances in the processing of inland cases (the program to reduce inventory started June 13, and it's been churning out PR's more often than outlanders; sometimes faster; it seems)

That's not entirely true for an Inland applicant.

While it's true that a person can certainly `leave', it's the re-entry into Canada that could be problematic.
