Can I apply for PR under FSW program from within Canada

Hi,

I've been working in Canada for 3 months in ICT (Intra Company Transfer) Work Permit through my current employer as a Software Developer.

I've 10 years of work experience in same profession (outside of Canada; in India and USA).

Am I eligible to apply for Permanent Residence (PR) under FSW (Federal Skilled Worker) program? And if I can, how long it generally takes to get the PR? I know I'll be eligible to apply for PR under CEC (Canadian Experience Class) but I'll have to work for at least a year in Canada to be eligible to apply under CEC.

Please help.

You can apply under the regular FSW stream if your occupation appears on the list of 50 occupations and you mee the other application criteria (e.g. IELTs, 67 points, etc.). Note that some occupations (notably 2174) have capped by now.

You cannot apply under the FSW arranged employment stream. For that you would need an approved LMIA from your employer.

But how would I know if I would have to apply FSW under 'arranged employment stream'? From my situation as I mentioned in my original posting, do you think I need to go through that channel?

I can't answer that question.

You'll have to read through the requirements for FSW (without arranged employment) and see if you qualify.

Just an added note... At this point it's too late to apply without a job offer under NOC 2174 (CIC has definitely received far more than 1,000 by now). It's probably also very close to being too late (if it's not too late already) for NOC 2173.

My name is Shamit & i am currently working as a 'Sales Associate' with 7-Eleven. Below mentioned is my question :

With the current job can i apply for PR under FSW category without showing the proof of funds which are required to be shown if i do not have a job in Canada.

Also, if i can apply through my above mentioned job what should be mentioned in the letter which i would be getting issued by my employer.

No - you can't. To apply through the FSW arranged employer stream (which doesn't require proof of funds) your job must be NOC level A, B or 0. Your job doesn't qualify.

Just another quick question, what's the processing time of FSW (if applied from within Canada)? I know it's around 22 months if applied from New Delhi, India, and if it's significantly high and similar to this timeline, I'd not even consider applying in FSW program this year, rather would wait for next year's CEC program instead which is faster, I suppose, in terms of processing time (I'd be eligible for CEC in May 2015).

CIC's cap is outdated and an underestimation in that it does not reflect the number of applications it has received. Scylla was referring to the # of applications that CIC has already received for 2174, which has already reached more than 1000. So if you were to begin your process now, it will most certainly not be in the quota. In any case, the processing time for this year has been very fast. Some applicants who applied in May have already received PR.

If you don't already know, CIC is introducing new "express entry" process in Jan, 2015, which will replace a number of current PR application streams. CEC is one of them. So, there might be some changes to the qualifying criteria for this new process (not disclosed yet). What I would do in your situation is prepare an application based on current rules and keep tracking the updates and announcements from CIC. Check CIC's website for such information.

But the link that I've been following (unfortunately, it's not allowing me to paste the actual link here) is changing the counts. It was 404 last week and 481 this week. So how could that be outdated?

But anyway, am I correct saying that I can't apply this year in NOC 2174 at all (except application preparation as you said) and would have to wait until next year's CEC (or Express Entry)? If that's the case, that'd sum it up all!

The numbers on the CIC site only reflect the applications that have been reviewed and accepted for further processing. CIC is still working on applications from May - so that's all the count reflects. Last week they were working on dates like May 15th and 16th. This week CIC has made it to dates like May 21st and 22nd. So the numbers you see on the web site only reflect some of the applications received in May (and none of the applications received since). Since the count is already almost at 500 - this means the cap will be reached before the end of June. There are a large number of discussions on this forum where this delay is discussed and the fact the count is far behind is very well known. However if you still don't believe it, feel free to send in your application. If you do, you will receive it back unprocessed about 4-5 months later. Your choice.
