Can i appeal again if rejected under spp jan intake 2012 due Gap in studies

i had applied in Humber college for Diploma in tourism management under SPP jan intake 2012 the course is for 2 years and had submitted all my relevant documents on 24th Oct whereas today i.e. 29th oct i had received a call from my consultant that student visa has been refused by consulate and the reason mentioned is the gap between the studies and the application…and he has asked to make an appeal again based on further more documents…I would like to knw whether this type of appeal works and if so what is the overall time period such appeal takes and the expense..

Brief information of mine:

Completed Bcom in 2004 and than i had completed my Diploma in international airline and travel management as well as IATA/UFTAA foundation course which is certification course of canada in 2005.
since than i was employed in a PVT company till date and had put up all my docs for the visa still got a rejection due gap….

IELTS score 6.5 Bands

1. Since you are a graduate, how can you go for a Diploma course! You have around 7 years of gap since your graduation. You cannot expect a visa just by meeting the minimum requirement of SPP visa checklist. You need a solid profile, more of an academic nature, with your proposed education in Canada which must be relevant/compatible with your prior education, work history (if any). With such a long experience your only choice would be a University Course (possible a Master Degree Course).

2. I am sure “study gap” is not the only reason, so you ask your consultant to show the refusal letter. In fact, CHC (India) do not even provide any specific reason for refusal. They simply hand over one COMMON refusal format which includes many reasons.

3. There is no such specific procedure to go for appeal. Yes, there is one for which you need to pay few CAD and approach directly in Canada (clearly a wastage of time/energy). CHC (India) is a sovereign body and do not come under/entertain any local laws.


In the end, it’s not you but your road side consultant who is responsible for your visa refusal.

Thanks for the reply can u tell me whether is it now possible to change to a master course and re apply for student visa for same jan2012 intake under spp...

And was not clear from your reply that is there any such procedure of appeal against visa rejection

1. Post September-2011, you cannot apply under SPP over again. Your only option is to apply under ‘General Category’. You are late to apply for any Jan-2012 Master level admission in Canada. You can apply for May-2012/September-2012 intake.

2. There is one process (I am forgetting its name, it’s something like CAAPS) but I am sure, for this process you need to apply directly in Canada. It’s clearly wastage of time. At the most you shall get reason/processing of your file, but you CAN NOT expect visa under any circumstances.

would like to share that he is a renowned consultant with lots of Awards including Hind ratan Award and has an office at canada too....

@ Enfield i wanna ask you one question. Consultants must be knowing already that a graduate/Post graduate can never get visa for an Undergraduate Diploma/Degree course then Why do they suggest such courses to guys like rimzim if they already know the visa is going to be rejected? Do they get good amount of money for rejections?

this is not the only case of mine that i m opting for diploma after my graduation and gap, but one of my colligue was thru with the same profile for Sept 2010 under SPP only and has enrolled for diploma course in Transportation and Customs from Seneca and got successful.....

I know some graduates get visa for undergraduate courses but Chances of getting Visa in such cases is Very LOW.[/color]

Hi,

It really does not matter even if he hold NOBEL PEACE PRIZE. In the end, it's your visa approval which matters a lot. There can't be anything bigger thn your visa.

Hi,

I think now your ONLY option is to apply for a Master degree course in a University (since you graduate with gaps/work history).

I don't think if there is any question of going back to Diploma, PG Diploma etc.
