i need help pls i'm married with canadian woman she have 26 and me 30 and the problme we married before her divorce and we didn't send our apllication yet and we say our mariege is illegal and the immigration they will refuse us then pls what we will do our good application help us pls we didn't enything right now juste married and we didn't apply right now
and she stayed with me here in morocco 7 month we married 9/9/2008 and her divore came 17 /10/2008

pls what we can do and soon we will have bebe maybe 16/06/2009

Your marriage was illegal,so you would have to marry again.

If you have a legal marriage at the time of application it will be fine. But you will probably have to explain why you married when she wasn't even divorced yet! If you have a lawyer I am sure they will help you with that. Ask your lawyer for advice.. If you are divorcing and marrying in the same country I don't see how the marriage was valid in the first place. Get advice from your lawyer..

Thank you so much why we married before she divorce she was pregnent and here in morocco they can't get You married for the day when you come no they told You you must to go tu juge and they write the day when she get pregnent that the islam for not say oh that is not my son about dicorce and married here in morocco like 2 month i can finish all that in 2 month is not problme here just ask did CIC will accept our application when we divorce and remaried

Unfortunately here in Canada and according to CIC your marriage is illegal since she was not yet officially divorced. One of a several things can happen;

1. CIC will refuse your application because your wife was still married at the time you two were married. If this happens you would need to start all over and re-apply again.

2. CIC will ask that you now marry legally and re-submit your new marriage certificate to update the file. If this happens your application will remain on hold until the new marriage cert is received.

Either way there will be a delay. I wish you the best of luck!

she came 7 september 2008 and we was like chum and blond ok she divorced 17 october 2008 then after one month in ottawa
we recived her devorce from canada in the 15- 12 -2008 then we started to process of getting a proper marriage certificate in Morocco
and we went to embassy in Rabat we ger certificate of nationality and all and but the law here in morocco it say you can't marry her in the same date you must to do the first day when you getting pregnent it was 23 september 2008 then we say them for make us married but we didn't see that her devorce it was in the 17 october 2008 then we married before her devorce come ok judge also they didn't see that too then we give us to marreid we went to adul we get certificate of mariege good that all but the problme when she back to canada she star to full aplication with lawyer but the lawyer see that he told us that is not good they wil refuse your aplication she said him what we can do he said her you must to go to morocco and devorce and remarried again ok we will do that and will married again .

but my question did the CIC will accpet our aplication for sponsoring me and the lawyer he will explain to them all the in palication

with all that she stayed with here in morocco 7 months and our weeding it was 1 mars 2009

i think i explain all i hope to find a good answer pls help us i need advice

Yes it will be fine with an explanation from your lawyer. You must remarry with all the requirements from the embassy, so that it is legal and recognised by CIC.

she was married in canada but she didn't sponsoring him he met him in canada and she married with him from 2002 to 2007 her speration then she asked divorce after one year of separation then she apply her dicorce 30 - 7 - 2008 and she come here 9-9-2008 and she get her divorce in the 17-10-2008 her divorce is legal in canada

the law in morocco they don't accept mariege normal when the wife pregnent it must to write that in certificate mariege it's ok now we will fix our problem as soon as possible she will come in the 14 aout 2009 with my beautiful son inchaAllah


but did CIC will accpet our aplication for have PR when we apply with new mariege because we didn't apply yet we waiting for fix that

Like I said with lots of explanation.. I don't understand how a judge or whatever would allow to "switch" dates because she is pregnant and she wouldn't have even been divorced at this time!!! That is illegal! Your new marriage will be recognised but I can warn you that this whole situation is going to raise alot of red flags to the immigration officer dealing with your case!

Boncuk, you're awesome to help but this guy is getting all of his answers on the Morocco thread. Three of us are trying to sort the story and help him because they didn't follow the law in Canada OR Morocco. Yup, what he did was illegal and his lawyer already gave him advice about what needs to be done. I think he's looking for a guarantee of acceptance of PR once they re-marry. We all know there are NO guarantees in Immigration!!! And you are SO right. Red flags everywhere.

Sigh.. I just read it.. Samy.. no one here is going to say yes you are accepted and your marriage is legal.. we just tell you what we know from the rules that our set out by our government and from our own personal experiences and knowledge from reading. Talk to your lawyer and best of luck in your process.. without sounding mean.. you will need to explain it all very well.. your lawyer will anyway.. babies and your word are great but you need A LOT more evidence and explanation to make a solid case to the immigration officer.. I'm sorry if this sounds mean or wrong.. but it really is fact of the matter.
