Hi seniors,

I filed for resignation this week. My last working day with the company is on March 20. My closed work permit and work visa will expire on June 11, 2015. I already got a PPR for my CEC application last week.

My employer told me that they will notify CIC that starting March 21, my work visa should be cancelled. And that I would have to leave Canada.

Can employers cancel my work visa?

Please advice.

Thanks!

No they cannot. They can inform CIC but that does not cancels your work permit or visa.

As of my kknowledge no... they cant do that... but call CIC call center and get confirmation..

However, if you would like to stay here you can apply BOWP immediately and u are officially allowed to stay in Canada until u get ur BOWP..
I believe u should get ur PR before that.. dont worrly.. all the best..

Hi Annapot29,

If you land after 20th March, I would suggest to land at CIC inland office so you do not run into problems if your employer has advised CIC that they do not anymore sponsor the closed work permit.

Wish you good luck and keep on sharing your experience with forum.

Hope this helps!

I know few in my company who face the same situation. Company can never do that. Its illegal. The only trv is cancelled when you get PR. Moreover visa is your personal document and for work permit the only way to cancel is trash it, no once can cancel it. Hope it helps

Apply for BOWP ASAP as you are within the 4 month window before your existing WP expires. In my situation my employer did contact CIC but it made no difference since I was moving to a job outside Canada.

Good luck.

Don't worry, your employer cannot revoke your wp. Your employer cannot even threat you to revoke your wp or change your immigration status. Here read about your rights:
http://www.cic.gc.ca/english/resources/publications/tfw-rights.asp
You can report your employer.
