A few months ago we had it with Canada, and decided to return back to Europe (France). We're back on track on good paying jobs which Canada refused to consider us for. Our plan is to live in Spain in a year or two when our savings will have grown back to afford another move.

When we left Canada we still had an unsecured debt of 7K and outstanding credit cards 25K.

Can we be prosecuted in Canada if they don't serve us personally?

Can they sell the debt to a European collection agency or claim the debt in Europe?

I cannot answer your questions specifically however you could end up in some real trouble if you don't sort the debt out.

I don't think Canadians can come chasing for you in Europe for your money. However, if lending company files criminal charges against you, you have to be present in the court for hearing in Canada. If you are not present and do not respond to court orders then court could declare you fugitive and put additional charges on you.

This would make is very difficult to travel outside EU for you. Because almost every visa application will ask you about any frauds or criminal charges on you. If you don't provide those details and they find out, then you'd be in even more trouble so my advice would is be careful and try to talk to your lender and find an acceptable option.

Not talking to them and running away is probably the worst option.
