Hi all,

I still have time with my work permit... but I see everybody once got AOR applies for the BWOP... but I was planning to stay as implied status as your status is frozen at the moment CIC gets your application... So my question what is the best way to do it and which are the differences on those options.

The important thing is to have legal status in the country. That is paramount. If I understand the question here - what were you referring to as the "application" mentioned here - a BOWP application or your PR application?

Implied status is not a bad option per se - and it all depends on timing of when the AoR comes out so you can use it for your BOWP application. And yes - once your current WP expires but you have a WP application already on-going, you get the benefit of implied status. It always boins down to timing - when does the AoR come out vs the amount of time you have left on your current legal status.

The risks of going on implied status is you are entirely dependent on the results of the BOWP application. If it is negative, then you are out-of-status, and then need to apply for restoration if you intend to stay in the country. But then again - while on restoration (you may have read posts on that) - your former status (as a worker) does not apply - you can'c continue working, but you can continue to stay in the country till you get results of the restoration application.

I was a little worry about my legal status as I can not use the BWOP... but I found this info that helps a lot I believe...

Open work permit

An open work permit allows you to work for any employer for the time period specified on the work permit. Once you receive your first stage approval (approval in principle) of your application, it can only be granted for your permanent residency.

If you send your open work permit application along with your permanent residence application and you continue working for the employer who mentioned on your current work permit while the application is being processed, then you will not need to extend your work permit, even if it expires during the processing of your application for permanent residence.

If you want to change your employer after sending your application, you will need to submit a new application for a work permit along with a new positive Labour Market Opinion issued by HRSDC or Service Canada to your employer and pay the appropriate fees.
